Description

Gegenstand der Ausschreibung ist der Abschluss einer Rahmenvereinbarung über die Lieferung von Papier für die in der Auftragsbekanntmachung benannten abrufberechtigten öffentlichen Auftraggeber. Die KoPart eG ist die Einkaufsgenossenschaft des Städte- und Gemeindebundes Nordrhein-Westfalen. Zu ihren Mitgliedern zählen Kommunen und Unternehmen in öffentlicher Trägerschaft. Sie führt das Vergabeverfahren für die teilnehmenden öffentlichen Auftraggeber durch und tritt dabei ausschließlich als ausschreibende Stelle auf. Die Beschaffung und die Abwicklung der Einzelbestellungen erfolgen über den elektronischen Katalogeinkauf der KoPart eG. Hierzu werden die ausgeschriebenen Artikel und die zugehörigen Konditionen nach Zuschlagserteilung in eine elektronische Bestellplattform integriert, deren Funktionsweise mit einem Webshop vergleichbar ist. Die teilnehmenden Mitglieder sollen ihren Papierbedarf möglichst umfassend über diese Plattform auf Grundlage der ausgeschriebenen Rahmenvereinbarung decken. Die von den Mitgliedern benannten und berechtigten Besteller erhalten einen persönlichen Online-Zugang. Sie stellen die benötigten Artikel in einem Warenkorb zusammen und übermitteln die Bestellung elektronisch an den jeweiligen Lieferanten. Dieser übernimmt die weitere Bestellabwicklung und die Lieferung nach Maßgabe der Rahmenvereinbarung. Der jeweilige Liefervertrag kommt ausschließlich zwischen dem Lieferanten und dem bestellenden Mitglied zustande. Die KoPart eG wird nicht Vertragspartnerin der einzelnen Lieferverträge. Weitere Mitglieder können während der Laufzeit für den elektronischen Katalogeinkauf freigeschaltet werden, sofern sie zu den in der Auftragsbekanntmachung benannten abrufberechtigten öffentlichen Auftraggebern gehören. Der spätere Beitritt zur KoPart eG oder die Freischaltung für die Bestellplattform begründet für sich allein kein Abrufrecht aus dieser Rahmenvereinbarung.
