Die KoPart eG ist die Einkaufsgenossenschaft des Städte- und Gemeindebundes Nordrhein-Westfalen. Ihre Mitglieder sind Kommunen und Unternehmen in öffentlicher Trägerschaft. Für eine Reihe dieser Mitgliedskommunen (Teilnehmer am Elektronischen Katalogeinkauf der KoPart, sowie mögliche zukünftige Mitglieder) beabsichtigt die KoPart eG, die Rahmenvereinbarung zur Lieferung von Schulmöbeln zu vergeben. Der Kreis, der am elektronischen Katalogeinkauf teilnehmenden Mitglieder, kann jederzeit aus dem Mitgliederkreis der KoPart erweitert werden. Die Mitgliederliste ist im Internet einsehbar. Daneben können auch weitere öffentliche Auftraggeber Mitglied der KoPart eG werden und dann auf die Rahmenvereinbarungen zugreifen. Die KoPart eG tritt bei der Vergabe der Rahmenvereinbarungen ausschließlich als ausschreibende Stelle auf. Die Leistungsbeschreibungen werden nach Zuschlagserteilung in den elektronischen Katalogeinkauf der KoPart (Funktionsweise vergleichbar mit einem Webshop) integriert. Die aufgeschalteten Mitglieder der KoPart sollen ihren Bedarf möglichst erschöpfend im Wege des elektronischen Katalogeinkaufs aus den ausgeschriebenen Rahmenvereinbarungen decken. Dazu erhalten die von den Mitgliedern benannten Besteller einen Online-Zugang zur Bestellplattform. Dort können die berechtigten Besteller sich einen Warenkorb zusammenstellen, welcher dann elektronisch an den betreffenden Lieferanten weitergeleitet wird. Dieser wiederum wickelt die weitere Bestellung ab. Der Vertrag über die Lieferung der Ware kommt dabei ausschließlich zwischen dem Lieferanten und dem jeweiligen Mitglied zustande. Die KoPart wird nicht Vertragspartner des Liefervertrages. Es besteht weder für die einzelnen Mitglieder noch für deren Besteller eine Pflicht, das Einkaufssystem zu nutzen.
