Description

Prin prezenta procedura de achizitie, se doreste incheierea unui acord cadru pentru o perioada de 12 luni si 4 contracte subsecvente astfel : primul pe perioada 01.01.2027-31.03.2027, al doilea pe perioada 01.04.2027-30.06.2027, al treilea pe perioada 01.07.2027-30.09.2027 si al patrulea pe perioada 01.10.2027-31.12.2027. Atribuirea acordului -cadru se va face cu maxim 2 operatori economici conform prevederilor Legii nr. 98/2016, art. 118, alin. (1), lit. a) ”fără reluarea competiţiei, în conformitate cu termenii şi condiţiile prevăzute în cuprinsul său, în cazul în care acordul-cadru stabileşte toţi termenii şi condiţiile care reglementează execuţia lucrărilor, prestarea serviciilor şi furnizarea produselor care constituie obiectul său, precum şi condiţiile obiective în funcţie de care se stabileşte care dintre operatorii economici parte la acordul-cadru va executa lucrările, va presta serviciile sau va furniza produsele”. Acordul cadru se va incheia cu maxim 2 operatori economici, fara reluarea competitiei, in ordinea clasamentului. Principalul furnizor este cel clasat pe locul I, iar in cazul in care acesta nu isi poate mentine pretul ofertat sau nu poate asigura livrarea solicitata, se va atribui contractul subsecvent urmatorului clasat. In stuatia in care conditiile concrete o impun, achizitorul va prelungi doar durata acordului cadru cu maxim 4 luni, conditionat de existenta resurselor finaciare si incadrarea in cantitatile maxime , conform art. 165 alin (1) din HG nr. 395/2016. Pretul va fi acelasi cu pretul contractat pe fiecare produs in parte. Locul principal de livrare: Sediile Centrelor de plasament, Caselor de tip familial si Centrelor de ingrijire si asistenta mentionate in Caietul de sarcini. Operatorii economici participanti la procedura de achizitie publica vor depune oferte pentru unul sau mai multe loturi. Oferta financiara va fi intocmita cu pretul unitar al fiecarui produs din caietul de sarcini pentru cantitatile maxime solicitate. Pretul ramane fix pe toata durata acordului cadru. Criteriul de atribuire al acordului cadru este: cel mai bun raport calitate-pret. Numarul de zile pana la care se pot solicita clarificari la documentatia de atribuire inainte de data limita de depunere a ofertelor - 18 zile. Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificari sau informatiilor suplimentare primite de la operatorii interesati in a 11-a zi inainte de data limita de depunere a ofertelor, in conformitate cu art. 161 din Legea nr. 98/2016, respectiv art. 173 din Legea nr. 99/2016. Termenele limită de primire a solicitărilor de clarificări, respectiv de transmitere a răspunsului autorității contractante au fost astfel calculate astfel încât operatorii economici sa beneficieze de cele 10 zile prevăzute de art.161 din Legea nr. 98/2016, respectiv art. 173 din Legea nr. 99/2016. Orice solicitare de clarificări trebuie transmisă în SEAP (http://e-licitatie.ro/pub). Valoarea estimata a celui mai mare contract subsecvent( pentru 6 loturi) care se estimeaza ca va fi incheiat pe durata acordului cadru este CS2: val min=401.700,71 lei; val max=1.062.712,79 lei, astfel: LOT 1.
