Gegenstand der Ausschreibung sind die Planung, Errichtung und der Betrieb eines Gigabitnetzes sowie die Versorgung der unterversorgten "Grauen Flecken" der Gemeinde Spiesen-Elversberg mit Diensten eines nachhaltigen und hochleistungsfähigen Gigabit-Netzes. Hierbei handelt es sich um eine Dienstleistungskonzession. Der Konzessionsgeber beabsichtigt die Erschließung durch ein Gigabit-Netz zu realisieren, für dessen Errichtung und Betrieb eine Investitionsbeihilfe gewährt wird (sog. Wirtschaftlichkeitslückenmodell). Gegenstand der Ausschreibung ist die Versorgung von "Grauen Flecken" mit Diensten eines nachhaltigen und hochleistungsfähigen Gigabit-Netzes. Hierbei handelt es sich um eine Dienstleistungskonzession. Der Konzessionsgeber beabsichtigt, die Erschließung als Gigabit-Netz zu realisieren. Gegenstand der Konzession sind im Wesentlichen die Planung, die Errichtung und der Betrieb eines Gigabit-Breitbandnetzes sowie die Versorgung mit hochleistungsfähigen Breitbandanschlüssen als Endkundenprodukte. Hierzu erfolgt die beabsichtigte Konzessionsvergabe im Rahmen der Schließung einer Wirtschaftlichkeitslücke im Wirtschaftlichkeitslückenmodell. Das Gigabit-Netz soll vom Konzessionsnehmer geplant, errichtet und anschließend betrieben und zur Versorgung der Endkunden im Konzessionsgebiet genutzt werden. Es sollen nach dem Ausbau insgesamt 23 Adressen im Konzessionsgebiet mit gigabitfähigen Anschlüssen erschlossen sein. Die Konzessionierung erfolgt unter Beachtung der Leitlinien der Europäischen Union für die Anwendung der Vorschriften über staatliche Beihilfen im Zusammenhang mit dem schnellen Breitbandausbau (2013/C 25/01) sowie der Rahmenregelung der Bundesrepublik Deutschland zur Unterstützung des flächendeckenden Aufbaus von Gigabitnetzen in "grauen Flecken" (Gigabit-RR). Die Gemeinde Spiesen-Elversberg hat auf Grundlage der Richtlinie für die Förderung zur Unterstützung des Gigabitausbaus der Telekommunikationsnetze in der Bundesrepublik Deutschland (Gigabit-RL 2.0) vom 31.03.2023 in der Änderungsfassung vom 30.04.2024 durch den vorläufigen Zuwendungsbescheid des Bundes vom 14.11.2024 sowie auf Grundlage der Richtlinie über die Kofinanzierung der Gigabitförderung des Bundes im Saarland den vorläufigen Zuwendungsbescheid des Landes vom 26.05.2025 erhalten. Die Förderung erfolgt in Form des Wirtschaftlichkeitslückenmodells gemäß Ziff. 3.1 der BMVI Förderrichtlinie i.V.m § 3 Abs. 1 lit. a der Gigabit-Rahmenregelung.
