Description

Das Landesamt für Zentrale Polizeiliche Dienste Nordrhein-Westfalen beabsichtigt, im Zuge des vorliegenden offenen Verfahrens mit einem Wirtschaftsteilnehmer eine Rahmenvereinbarung über die Lieferung von Einsatzhandschuhen für die Polizei NRW abzuschließen. Die Rahmenvereinbarung hat eine Mindestlaufzeit von zwei Jahren. Es besteht die Möglichkeit die Rahmenvereinbarung zweimal jeweils um ein weiteres Jahr zu verlängern. Die Rahmenvereinbarung hat somit eine Maximallaufzeit von vier Jahren. Im Hinblick auf die Rahmenvereinbarung werden keine Mindestabnahmemengen vereinbart. Nach Rechtsprechung des EuGH vom 17.06.2021_RS C - 23/20 - ist der Auftraggeber zur Sicherung der Transparenz und Diskriminierungsfreiheit im Wettbewerb dazu verpflichtet, eine Höchstmenge anzugeben. Eine Abrufverpflichtung kann daraus nicht abgeleitet werden. Der Auftraggeber schätzt, dass über die gesamte Vertragslaufzeit ein Bedarf von ca. 21.400 Einsatzhandschuhen besteht. Die Höchstmenge der anliegenden Rahmenvereinbarungen wird auf 25.000 Paar Einsatzhandschuhe beziffert.
