Die Bayerische Polizei beabsichtigt die Beschaffung von Winterstiefeln. Der AG sichert dem AN während der gesamten Vertragslaufzeit die Abnahme folgender Abnahmemengen zu. Diese sind der Kalkulation zu Grunde zu legen: Verbindliche Mindestabnahmemenge (entspricht der Schätzmenge): 1.500 Paar Winterstiefel. Darüber hinaus stellt der AN sicher, dass folgende unverbindliche Abnahmemengen während der gesamten Vertragslaufzeit abgenommen werden können: Unverbindliche Abnahmemenge: 2.500 Paar Winterstiefel. Als Höchstabnahmemenge werden während der gesamten Vertragslaufzeit vereinbart: 4.000 Paar Winterstiefel. Die Mitteilung der Größenaufteilung erfolgt bei Erteilung der Einzelaufträge (Bestellungen). Der AN hat nur Anspruch auf die Abnahme der vertraglich vereinbarten Mindestabnahmemengen. Bei den darüberhinausgehenden genannten Mengen handelt es sich um unverbindliche Bedarfszahlen. Ein Anspruch des ANs auf Abnahme dieser voraussichtlichen Menge besteht nicht. Über die vertraglich vereinbarte Mindestabnahmemenge hinausgehende Abnahmemengen sind von verschiedenen Faktoren (Verschleiß, Anzahl an neuen Einsatzkräften, etc.) abhängig, es kann daher hinsichtlich der zusätzlichen, unverbindlichen Abnahmemenge lediglich eine Schätzung erfolgen. Da es sich um eine Rahmenvereinbarung handelt, können die unverbindlichen Abnahmemengen während der Vertragslaufzeit gegebenenfalls über- bzw. unterschritten werden.
