Das Landesamt für Zentrale Polizeiliche Dienste Nordrhein-Westfalen beabsichtigt, im Zuge des vorliegenden offenen Verfahrens einen EVB-IT Erstellungsvertrag für die Erstellung einer schlüsselfertigen PKI-Lösung auf Basis von Hardware-Appliances zur manuellen und automatisierten Bereitstellung von digitalen Zertifikaten für den internen Einsatz bei der Polizei NRW gemäß Leistungsbeschreibung (Kapitel B) zu vergeben. Im Hinblick auf die Rahmenvereinbarung werden keine Mindestabnahmemengen vereinbart. Nach Rechtsprechung des EuGH vom 17.06.2021_RS C - 23/20 - ist der Auftraggeber zur Sicherung der Transparenz und Diskriminierungsfreiheit im Wettbewerb dazu verpflichtet, eine Höchstmenge anzugeben. Eine Abrufverpflichtung kann daraus nicht abgeleitet werden. Der Auftraggeber schätzt, dass während der gesamten Vertragslaufzeit Produkte und Leistungen in Höhe von ca. 500.000 Euro aus der Rahmenvereinbarung abgerufen werden. Die Höchstmenge der anliegenden Rahmenvereinbarungen wird auf 600.000 Euro beziffert. Die Rahmenvereinbarung endet ohne dass es einer Kündigung bedarf, je nachdem welches Ereignis früher eintritt, mit dem Ablauf der Laufzeit der Rahmenvereinbarung (Mindestlaufzeit bei Betätigung des Kündigungsrechts durch den Auftraggeber, oder Maximallaufzeit bei fehlender Kündigung des Auftraggebers) oder bei Erreichen der Höchstmenge.
