Description

Przedmiotem zamówienia jest świadczenie: 1) usług opiekuńczych lub specjalistycznych usług opiekuńczych dostosowanych do szczególnych potrzeb wynikających z rodzaju schorzenia lub niepełnosprawności świadczonych przez osoby ze specjalistycznym przygotowaniem zawodowym - na rzecz 380 osób miesięcznie, 2) specjalistycznych usług opiekuńczych dla osób z zaburzeniami psychicznymi - na rzecz 20 osób miesięcznie, zgodnie z ustawą z dnia 12 marca 2004 r. o pomocy społecznej (t.j. Dz. U. z 2026 r. poz. 639, 974, 986) oraz rozporządzeniem Ministra Polityki Społecznej z dnia 22 września 2005 r. w sprawie specjalistycznych usług opiekuńczych (tj. Dz. U. z 2024 r. poz. 816) i rozporządzeniem Ministra Rodziny, Pracy i Polityki Społecznej z dnia 04 sierpnia 2026 r. w sprawie usług opiekuńczych w miejscu zamieszkania,wyłącznie dla mieszkańców Legnicy, w granicach administracyjnych miasta Legnicy. Postępowanie prowadzone jest w na podstawie art. 359 pkt 1) w związku z art. 132 i następnych ustawy z dnia 11 września 2019 r. - Prawo zamówień publicznych, właściwych dla zamówień klasycznych o wartości równej albo przekraczającej progi unijne, w związku z tym Zamawiający korzystając z uprawnień w nim zapisanych: 1) zamiast formularza jednolitego dokumentu (JEDZ), żąda dołączenia przez Wykonawcę do oferty oświadczenia o niepodleganiu wykluczeniu i spełnianiu warunków udziału - art. 125 ust.1 u.p.z.p. 2) skraca minimalny termin składania ofert do 15 dni, na podstawie art. 138. ust. 2 pkt 2 u.p.z.p., ponieważ zachodzi pilna potrzeba udzielenia zamówienia. 2. Przedmiotem zamówienia są usługi wymienione w załączniku XIV do Dyrektywy Parlamentu Europejskiego i Rady nr 2014/24/UE z dnia 26 lutego 2014 r. w sprawie zamówień publicznych, uchylająca dyrektywę 2004/18/WE. Nazwy i kody wg Wspólnego Słownika Zamówień: 85000000- 9 usługi w zakresie zdrowia i opieki społecznej 85311200-4 usługi społecznej opieki dla osób niepełnosprawnych.
