Description

1.Przedmiotem zamówienia jest dostawa dodatkowych subskrypcji Dynatrace lub rozwiązania równoważnego wraz z wsparciem technicznym oraz godzinami eksperckimi. 2. Zamówienie zostało podzielone na zamówienie podstawowe oraz prawo opcji: 2.1. Zamówienie podstawowe: dostawa Subskrypcji obejmującej produkty wyszczególnione w Tabeli przedstawionej w pkt. 5.1. rozdziału II SWZ - OPZ albo rozwiązania równoważnego, zgodnie z opisem równoważności określonym w pkt. 8 OPZ, wraz z zapewnieniem Wsparcia Technicznego Producenta - zgodnie z rozdziałem II SWZ - OPZ; 2.2. Zamówienie w ramach opcji: 2.2.1. Zapewnienie Wsparcia Eksperckiego, w wymiarze maksymalnie 3000 roboczogodzin - na zasadach opisanych szczegółowo w pkt. 6 Rozdziału II SWZ - OPZ. 2.2.2. Przedłużenie Subskrypcji aktualnie używanych (568 Host Unit Offline, 25 mln DEM Units Offline, 1 mln DDU Units Offline) lub zapewnienie licencji równoważnych wraz ze Wsparciem Technicznym Producenta na okres 12 miesięcy od 03.04.2027 r. 3. Przedmiot zamówienia został szczegółowo opisany w rozdziale II SWZ - Opis przedmiotu zamówienia. 4. Zamawiający w myśl art. 139 ustawy Pzp przewiduje odwróconą kolejność oceny ofert, tj. najpierw dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu. 5. Zamawiający jest administratorem danych osobowych w rozumieniu Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27.4.2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia Dyrektywy 95/46/WE dalej „RODO”. 6. Wykonawca składa ofertę za pośrednictwem Platformy eZamówienia Urzędu Zamówień Publicznych - https://ezamowienia.gov.pl/pl/. 7. Zamawiający zastrzega, iż zgodnie z art. 257 ustawy Pzp, może unieważnić postępowanie o udzielenie zamówienia, jeżeli środki publiczne, które Zamawiający zamierzał przeznaczyć na sfinansowanie zamówienia, nie zostaną mu przyznane. 8. Ofertę składa się, pod rygorem nieważności, w formie elektronicznej, według wymagań ściśle określonych w SWZ. 9. Zamawiający nie udzieli zamówienia jeśli zachodzą okoliczności, o których mowa w art. 5k Rozporządzenia Rady (UE) nr 833/2014 z dnia 31 lipca 2014 r. dot. środków organizacyjnych w związku z działaniami Rosji destabilizującymi sytuację na Ukrainie (DZ. Urz. UE nr L 229/1 z 31.7.2014) oraz wykluczy Wykonawcę w przypadku zaistnienia co najmniej jednej z przesłanek wykluczenia określonych w art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (t.j. Dz.U. z 2025 r. poz. 514) - w celu potwierdzenia braku postaw do wykluczenia należy złożyć wraz z ofertą oświadczenie stanowiące załącznik nr 7 do Formularza oferty. zgodnie z OPZ
