Ärztliche Besetzung der Intensivtransportwagen (ITW) des Essener Rettungsdienstes Die Stadt Essen beabsichtigt die Durchführung der ärztlichen Besetzung zweier Intensivtransportwagen (ITW) im Wege eines Offenen Verfahrens nach den Richtlinien der Verordnung über die Vergabe öffentlicher Aufträge (VgV) und des Gesetzes gegen Wettbewerbsbeschränkungen (GWB) zu beauftragen. Die Stadt Essen ist Trägerin des Rettungsdienstes gemäß § 6 Abs. 1 RettG NRW. Die Durchführung von Intensivtransporten ist eine Aufgabe des Rettungsdienstes gem. § 2 Abs. 1 in Verbindung mit § 3 Abs. 4 RettG NRW. Ein Intensivtransport ist ein aus medizinischer Sicht notwendiger Transport eines Patienten von einer Behandlungseinrichtung in eine für die weitere Versorgung der Patienten geeignete Behandlungseinrichtung unter intensivmedizinischen Bedingungen. Der Auftragnehmer handelt für die Trägerin des Rettungsdienstes und erbringt keine eigene, im Außenverhältnis liquidierbare Leistung gegenüber Patienten oder Krankenkassen. Das Rettungsmittel (hier Intensivtransportwagen; kurz: ITW) samt nichtärztlichem Personal und die medizinische Ausstattung werden durch die Feuerwehr Essen, im Folgenden Aufgabenträgerin (AT), bereitgestellt und sind nicht Teil der vom AN geschuldeten Leistung.
