Description

Für die Durchführung von Vergabeverfahren oberhalb des Schwellenwertes wird eine vergaberechtliche Unterstützung zur rechtssicheren Erstellung von Vergabeunterlagen sowie Bearbeitung von rechtlichen Sachverhalten vor, während und nach Vergabeverfahren benötigt. Mit dem Abschluss des Rahmenvertrages (12/2025 - 11/2029) soll sichergestellt werden, dass die Vergabeverfahren flexibel und wenn nötig ebenso kurzfristig anwaltlich betreut werden. Dies beinhaltet unter anderem die Erstellung von Vergabeunterlagen, die Vorbereitung von Schreiben, die dazugehörige rechtliche Beratung, der Vergabedokumentation, rechtlicher Beistand bei Problemen mit der Vertragsdurchführung sowie die hierfür notwendigen Assistenzarbeiten seitens des Auftragnehmers. Die Leistungen aus dem Rahmenvertrag werden vom Auftraggeber schriftlich durch Einzelaufträge abgerufen. Ebenso Abrufberechtigte Behörden i. S. v. § 21 Abs. 2 VgV sind neben der BAW, mit vorheriger schriftlicher Zustimmung durch die BAW, die Behörden der WSV. Der Auftraggeber hat jedoch keine Pflicht, innerhalb des Rahmenvertrages entsprechende Leistungen abzurufen. Weitere Einzelheiten sind in der Leistungsbeschreibung (Anlage 12) enthalten.
