Description

Gegenstand der vorliegenden Ausschreibung sind Leistungen der Fachplanung Technische Ausrüstung der Anlagengruppen 4 und 5 (Starkstromanlagen und Fernmelde- und informationstechnische Anlagen) nach § 55 HOAI 2021 i.V.m. Anlage 15, Leistungsphasen 1 bis 9, für den Neubau Regionalversorger der Kliniken Ostalb am Standort Essin-gen. Gegenstand der vorliegenden Ausschreibung sind Leistungen der Fachplanung Technische Ausrüstung der Anlagengruppen 4 und 5 (Starkstromanlagen und Fernmelde- und informationstechnische Anlagen) nach § 55 HOAI 2021 i.V.m. Anlage 15, Leistungsphasen 1 bis 9, für den Neubau Regionalversorger der Kliniken Ostalb am Standort Essingen. Die Fachplanungsleistungen Technische Ausrüstung werden stufenweise beauftragt, insbesondere soweit erwartete Fördermittel für die jeweilige Stufe bewilligt werden, soweit die Finanzierung gesichert ist und soweit keine schwerwiegenden Gründe gegen eine Weiterbeauftragung vorliegen. Hierbei handelt es sich um solche Gründe, die im Falle einer bereits erfolgten Beauftragung den Auftraggeber zu einer außerordentlichen Kün-digung berechtigen würden. Die Leistungen werden durch einseitigen Abruf beauftragt, und zwar entweder vollstän-dig oder beschränkt auf bestimmte Leistungsphasen (stufenweise Beauftragung). Der Auftragnehmer hat keinen Rechtsanspruch auf die Beauftragung einzelner oder gar aller Stufen. Der Umfang der vom Auftragnehmer zu erbringenden Leistungen ergibt sich aus dem Ingenieurvertrag und den Anlagen. Der Auftragnehmer hat die Vertragsbestandteile mit der Sachkunde eines erfahrenen Fachplaner Technische Ausrüstung sorgfältig auf Widersprüche, Lücken, Fehler, Un-stimmigkeiten und Unklarheiten zu prüfen und den Auftraggeber auf solche unverzüglich schriftlich hinzuweisen. Dabei stimmen die Vertragsparteien überein, dass diese Verpflichtung auch bereits im Stadium der Vertragsanbahnung gegolten hat.
