Es handelt sich nicht um ein offenes Verfahren, sondern um ein sog. open-house-Modell! Das Formular für das offene Verfahren wird lediglich deshalb verwandt, da kein Formular für das open-house-Modell existiert. Verträge, die im open-house-Modell geschlossen werden, unterfallen mangels Auswahlentscheidung nicht dem Vergaberecht. Eine Unterwerfung unter vergaberechtliche Regelungen ist mit der Verwendung dieses Formulars nicht verbunden. Die AOK Bayern beabsichtigt, mit allen Anbietern von Blutzuckerteststreifen nicht-exklusive Rabattvereinbarungen über Blutzuckerteststreifen nach § 130a Abs. 8 SGB V zu schließen. Die AOK Bayern bietet allen interessierten Anbietern von Blutzuckerteststreifen, die die unten genannten Eignungsvoraussetzungen erfüllen, den Abschluss identischer und nicht individuell verhandelbarer Rabattvereinbarungen an. Der frühestmögliche Vertragsbeginn ist der 01.09.2025, alle Verträge enden am 31.08.2027. Ein Vertragsschluss ist während dieser Laufzeit jederzeit möglich, spätestens jedoch am 03.07.2027. Nach Ablauf einer Frist von 12 Monaten ist der Vertrag ordentlich, mit einer Frist von 3 Monaten zum Quartalsende, kündbar. Bei Inkrafttreten eines durch bundesweite oder landesspezifische, im offenen Verfahren geschlossenen Rabattvertrags über Blutzuckerteststreifen treten die open-house-Vereinbarungen automatisch für die entsprechende Laufzeit außer Kraft. Ein Vertrag wird mit allen interessierten Anbietern geschlossen, die ihre Eignung durch eine ausgefüllte und unterschriebene Eigenerklärung zur Zuverlässigkeit nachweisen. Der Anbieter hat den ausgefüllten und unterzeichneten (die Vertretungsberechtigung des/der Unterzeichner/s muss sich aus dem Handelsregisterauszug ergeben, anderenfalls ist eine Vollmacht vorzulegen) Vertrag nebst ausgefüllter und unterzeichneter Anlage "Festlegung der vertragsgegenständlichen Arzneimittel" sowie die ausgefüllte und unterzeichnete Eigenerklärung zur Zuverlässigkeit einzureichen. Die Unterlagen können ENTWEDER in SCHRIFTFORM von Hand unterzeichnet ODER ELEKTRONISCH mit einer qualifizierten elektronischen Signatur eingereicht werden. Von Hand unterzeichnete Unterlagen in SCHRIFTFORM sind in 2-facher Fassung im Original an folgende Adresse einzusenden: AOK Bayern - Die Gesundheitskasse Vergabestelle SGB V ZE25 open-house Rabattverträge Carl-Wery-Str. 28 81739 München ELEKTRONISCHE Unterlagen mit einer qualifizierten elektronischen Signatur sind über den Kommunikationsbereich im Vergabeportal www.dtvp.de einzureichen. Bei Eingang vollständiger und korrekter Unterlagen bis zum 03. eines jeden Monats erfolgt der Vertragsbeginn zum darauf folgenden nächsten Monatsersten, ansonsten zum darauf folgenden übernächsten Monatsersten. Bei von Hand unterzeichneten Unterlagen in SCHRIFTFORM ist eine Übersendung der vollständigen, ausgefüllten und unterzeichneten Unterlagen vorab per Fax (089/62730650151), als Scan an die E-Mail-Adresse vergabestelle1@by.aok.de oder über den Kommunikationsbereich im Vergabeportal www.dtvp.de fristwahrend, wenn die vollständigen und korrekten Originalunterlagen in Papierform bis zum 10. des Monats bei der AOK Bayern, Vergabestelle, eingehen. Bitte beachten Sie die Ausfüllanleitung, die unter www.dtvp.de bei den Vergabeunterlagen zur Verfügung gestellt wird. Interessierte Anbieter können im Projektraum zum Open-House-Verfahren auf dem Portal www.dtvp.de die Freischaltung der Vergabeunterlagen beantragen. Ein Link zum Portal befindet sich in dieser Bekanntmachung. Als potentielle Vertragspartner kommen ausschließlich Anbieter von Blutzuckerteststreifen in Betracht. Die Unterlagen des Open-House-Verfahrens werden ausschließlich Anbietern von Blutzuckerteststreifen als potentiellen Vertragspartnern freigeschalten und sind streng vertraulich zu behandeln. Durch die Beantragung der Freischaltung durch die Unternehmen wird die vertrauliche Behandlung der Unterlagen bestätigt. Siehe kurze Beschreibung ACHTUNG: Die Vertragsunterlagen sind zwingend über den Kommunikationsbereich im Vergabeportal www.dtvp.de einzureichen und keinesfalls über den Angebotsbereich! BITTE BEACHTEN SIE: Die FRIST für einen Vertragsschluss zum nächsten Monatsersten endet jeweils am DRITTEN des Vormonats.
