Die vorliegende Bekanntmachung dient dem Abschluss von Arzneimittelrabattverträgen gemäß §§ 130 a Abs. 8 bzw. 130c Abs. 1 SGB. Es handelt sich nicht um die Vergabe öffentlicher Aufträge im Sinne der Richtlinie 2014/24/EU bzw. der §§ 97 ff GWB. Vertragspartner kann jeder pharmazeutische Unternehmer gemäß § 4 Abs. 18 AMG werden. Gemäß der Rechtsprechung des EuGH unterliegen derartige Zulassungsverfahren nicht zwingend dem Vergaberecht, da aufgrund der fehlenden Auswahlentscheidung kein Wettbewerb stattfindet. Die Bekanntmachung dient als Aufforderung zum Abschluss von Rabattverträgen mit für alle Vertragspartner gleich geltenden und nicht dispositiven Konditionen einschließlich der Festlegung des Rabattes. Der Vertragsschluss erfolgt durch Unterzeichnung der Vertragsunterlagen und Abgabe der geforderten Erklärungen, welche bei der benannten Kontaktstelle angefordert werden können. Die vorliegende Bekanntmachung dient dem Abschluss von Arzneimittelrabattverträgen gemäß § 130a Abs. 8 oder 130c Abs. 1 SGB V über den/die unter Titel genannten Wirkstoff(e).
