§ 130a Absatz 8 SGB V ermöglicht den Krankenkassen und pharmazeutischen Unternehmen, Rahmenrabattverträge über die zu Lasten der gesetzlichen Krankenkassen abzugebenden Arzneimittel zuschließen. In Hinblick auf die dafür einschlägigen gesetzlichen Vorschriften zur Vergabe öffentlicher Aufträge, findet ein regelmäßiger Prozess wirkstoffbezogener, förmlicher Vergabeverfahren nach den Regularien des 4. Teils des GWB durch die DAK-Gesundheit statt. Für vom Bieter näher in der Anlage 2 zum Vertrag zu benennende Arzneimittel zu dem o. g. Wirkstoff Glecaprevir und Pibrentasvir, ATC J05AP57, beabsichtigt die DAK-Gesundheit, bis zum Inkrafttreten neuer Arzneimittelrabattverträge mit möglichst allen interessierten pharmazeutischen Unternehmen Arzneimittelrabattverträge abzuschließen. Ein Rabattvertrag i.R.d. Zulassungsmodells zu dem o. g. Wirkstoff tritt erstmals am 01.09.2025 in Kraft und endet am 31.08.2027. Er endet unabhängig davon automatisch mit Inkrafttreten des Exklusivvertrages. Die DAK-Gesundheit geht davon aus, dass dieses Verfahren auf Grund einer fehlenden Auswahlentscheidung und mithin der diskriminierungsfreien Zugangsmöglichkeit aller pharmazeutischen Unternehmen nicht in den Anwendungsbereich des Kartellvergaberechts fällt. Er endet unabhängig davon automatisch mit Inkrafttreten des Exklusivvertrages zu Glecaprevir und Pibrentasvir, ATC J05AP57, in Folge eines förmlichen Vergabeverfahrens nach den Regularien des 4. Teils des GWB mit einem oder mehreren Vertragspartnern. Um der Vielfalt der potentiellen Vertragspartner im Rahmen des Zulassungsmodells gerecht zu werden, wird jedem pharmazeutischen Unternehmen während der Vertragslaufzeit der Abschluss eines Rahmenvertrags zu jeder Zeit und zu den gleichen Bedingungen ermöglicht. Die hierzu erforderlichen Vertragsunterlagen stehen über das Online-Portal www.dtvp.de/center unter dem unter 5.1.11. genannten Link zum Download zur Verfügung. Voraussetzungen für den Abschluss, bzw. den späteren Beitritt zu den erstmals am 01.09.2025 in Kraft tretenden Verträgen ist die vollständige und rechtzeitige Übersendung folgender Unterlagen (erhältlich zum Download unter dem unter 5.1.11. genannten Link) an die nachstehende Abteilung bei der DAK-Gesundheit: 1. Angebotsschreiben 2. Anerkennung der vertraglichen Maßgaben der DAK-Gesundheit, insbesondere auch der vorgegebenen Rabatte durch Einreichung des mit Namen oder Firmenstempel versehenen Vertrages durch den Interessenten an der vorgesehenen Stelle. 3. Die ausgefüllten Anlagen 1 und 2 zum Vertrag. Der Interessent hat hier die Arzneimittel zu dem o.g. Wirkstoff einzutragen, welche Vertragsgegenstand werden sollen. Die Unterlagen sind PER E-Mail einzureichen bei: openhouse@dak.de DAK-Gesundheit Fachbereich Arzneimittel (0038 00) Nagelsweg 27-31 20097 Hamburg Die Anlage 2 ist ausdrücklich als Exceldatei an die E-Mail-Adresse openhouse@dak.de zuschicken. Verträge im Rahmen dieses Modells und zum o.g. Wirkstoff werden erstmalig mit Wirkung zum 01.09.2025 abgeschlossen und enden am 31.08.2027.Interessenten, die zu diesem Termin Vertragspartner werden wollen, haben die o.g., einzureichenden Unterlagen bis zum 5. des Vormonats PER E-MAIL einzureichen. Das Angebot ist in Textform als elektronisches Angebot PER E-MAIL bei openhouse@dak.de einzureichen. Die Einreichung des Angebotes per Post ist in diesem Verfahren nicht vorgesehen. Bitte reichen Sie das Angebot NICHT über das Deutsche Vergabeportal ein. Für die Fristwahrung ist ein elektronischer Eingang der vollständigen Unterlagen PER E-MAIL an die E-Mail-Adresse openhouse@dak.de ausreichend. Spätere Beitritte sind jederzeit möglich. Um während der Laufzeit des Vertrages zum 1. oder 15. des Folgemonats beitreten zu können, müssen die o.g. Unterlagen, unabhängig vom gewünschten Beitritt, der DAK-Gesundheit bis zum 5. des Vormonats vorliegen. Auch hierbei kommt es auf den rechtzeitigen Zugang per E-Mail bei der DAK-G an. Beispiel: Der vom Bieter gewünschte Beitritt soll zum 15.07. (Folgemonat) erfolgen, die Unterlagen müssten hierfür bis zum 05.06. (Vormonat) vorliegen. Hinweis: Die Veröffentlichung erfolgt hier unter Verwendung des Formulars für Offene Verfahren. Wie bereits deutlich gemacht, handelt es sich hier um ein solches nicht - die Bekanntmachung musste aus technischen Gründen verwendet werden, da es kein für Zulassungsverfahren passendes Formular gibt.
