Description

De aanneming bestaat hoofdzakelijk uit het smeren van wissels en spoorremmen van de trieerinstallaties te Antwerpen-Haven. Het personeel dat de smering uitvoert wordt verder in dit bestek smeerder(s) genoemd. Het uitvoeren der smeerwerken ge-beurt steeds met buitendienst gesteld spoor. Het smeren zelf gebeurt steeds door 2 smeerders. Vóór iedere smeerbeurt van een wissel of spoorrem dient het aanwezige vuil en vet verwijderd te worden. Tijdens het smeren wordt de wissel of spoorrem visueel gecontroleerd op loshangende of losstaande onderdelen en wordt dit ge-meld aan de begeleidende bediende Infrabel. Bijkomend bestaat deze aanneming uit het inzetten van één of meerdere hydrauli-sche weg-spoorkranen (meestal 2 en maximum 2) met bestuurder(s) en het inzetten van 1 of 2 gekwalificeerde arbeiders voor prestaties aan de spoorremmen. De dienstverlener kan eigen werknemers inzetten voor de uitvoering van deze over-eenkomst, waarvoor hij uiteraard alle administratieve, arbeidsrechtelijke, sociale, fis-cale en andere lasten als werkgever in de ruime zin draagt en blijft dragen en na-komt ter volledige vrijwaring van de opdrachtgever-dienstenafnemer Infrabel. Het werkgeversgezag over deze werknemers blijft integraal bij de dienstenverlener. Deze zal onder meer beslissen over aanwerving, ontslag, promotie, het loon over-eenkomen met zijn werknemers en uitbetalen en zo meer. Indien de opdrachtgever eventueel en wanneer nodig instructies zou moeten geven, kunnen deze enkel be-trekking hebben op het welzijn op het werk, de arbeids-en rusttijden en de uitvoering van de taken bepaald in deze overeenkomst. Zij vormen in geen enkele zin een uit-voering van het gezag dat de werkgever toekomt. Beide gedeelten vinden plaats op dezelfde locatie, maar niet noodzakelijk gelijktijdig, zoals medegedeeld in artikel 149 van het tweede deel. De beveiligingen worden uitgevoerd door personeel van Infrabel. De hoeveelheden die in de inventaris worden vermeld zijn de beoogde hoeveelhe-den voor de gehele duur van de opdracht: initiële periode en alle eventuele verlen-gingen. Infrabel verbindt er zich niet toe om de in de inventaris vermelde prestaties en hoeveelheden te bestellen. De maximale waarde van de raamovereenkomst zal altijd het totaalbedrag van de 1e gerangschikte offerte bij de gunning zijn. Onder voorbehoud van de toepassing van de herzieningsclausules waarin het bestek voorziet, zal de raamovereenkomst ein-digen zodra de geplaatste deelopdrachten het genoemde totaalbedrag hebben be-reikt.
