Description

Hankintayksikkö voi valita suorahankinnan, jos teknisestä tai yksinoikeuden suojaamiseen liittyvästä syystä vain tietty toimittaja voi toteuttaa hankinnan; lisäedellytyksenä on, että järkeviä vaihtoehtoisia tai korvaavia ratkaisuja ei ole eikä kilpailun puuttuminen johdu hankinnan ehtojen keinotekoisesta kaventamisesta (hankintalaki 5 luku 40 § 2 mom. 2. kohta). Selvityksen perusteella valitun toimittajan kanssa tehtävä sopimus on ainoa vaihtoehto toteuttaa hankinta eikä hankinnan kohteelle ole olemassa järkeviä vaihtoehtoisia tai korvaavia ratkaisuja. SAS Institute Oy:n vastaavaa tuotetta ei ole markkinoilla ja SAS Institute Oy:lla on yksinoikeus Suomessa myytäviin SAS-lisensseihin.
