Operatorul economic declarat câștigător al procedurii de atribuire va elaborara documentaţia tehnica la faza: Proiect tehnic de execuție - P.T.E., Asistență tehnică din partea proiectantului pe perioada execuţiei lucrărilor, Proiect tehnic de execuție actualizat la data finalizării lucrărilor - As built, Documentație tehnică pentru obținerea Autorizației de gospodărire a apelor (dacă este cazul), Documentații pentru avize și acorduri și execuție de lucrări pentru „Modernizare infrastructură rutieră de drum județean 205L pe sectoarele: int. DJ 205D (Grumaz) - Vrâncioaia, Spinești - Păulești - Tulnici - int. DN2D”. Valoarea estimata a procedurii de achiziție publica este de: 77.871.020,24 lei fără T.V.A., fiind compusă din: 1.2. Amenajarea terenului - 762.000,00 lei fără T.V.A. 1.3. Obiectul contractului ce va fi atribuit prin prezenta procedură de achiziţie publică constă in achiziționarea serviciilor de elaborare a documentaţiei tehnice faza: Proiect tehnic de execuție - P.T.E., Asistență tehnică din partea proiectantului pe perioada execuţiei lucrărilor, Proiect tehnic de execuție actualizat la data finalizării lucrărilor - As built, Documentație tehnică pentru obținerea Autorizației de gospodărire a apelor (dacă este cazul), Documentații pentru avize și acorduri și execuție de lucrări pentru „Modernizare infrastructură rutieră de drum județean 205L pe sectoarele: int. DJ 205D (Grumaz) - Vrâncioaia, Spinești - Păulești - Tulnici - int. DN2D”. Durata de execuție a lucrărilor este de 30 luni. Durata de prestare a serviciilor de proiectare este de 3 luni. Serviciile de asistență tehnică din partea proiectantului vor fi prestate pe toată perioada de execuție a lucrărilor. Numarul de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor este de 20 zile. Autoritatea Contractanta va raspunde o singura data solicitarilor de clarificari in a 11-a zi inainte de data limita de depunere a ofertelor. Proiectul urmează a fi depus spre finanțate în cadrul Programului Regional Sud Est 2021-2027, Obiectiv specific 3.2 Dezvoltarea și creșterea unei mobilități naționale, regionale și locale durabile, reziliente la schimbările climatice, inteligente și intermodale, inclusiv îmbunătățirea accesului la TEN-T și a mobilității transfrontaliere, Acțiunea 4.1 - Investiții destinate reabilitării și modernizării infrastructurii rutiere de importanță regională pentru asigurarea conectivității la rețeaua TEN-T, Apel PRSE/4.1/2/2025. Autoritatea Contractantă precizează că va încheia contractul de achiziţie publică cu ofertantul declarat câştigător, sub condiție rezolutorie, în sensul că neobținerea finanțării prin Programul Regional Sud Est 2021-2027, în termen de maximum 12 luni de la data semnării contractului de achiziţie publică și constituirii GBE, conduce la desființarea de drept a contractului. În cazul îndeplinirii condiției rezolutorii (lipsa finanțării), contractul se consideră desființat cu efect retroactiv, ca și când nu ar fi fost niciodată încheiat, conform art. 1401 Cod Civil. Părțile convin ca, până la data îndeplinirii condiției sau a expirării termenului de maximum 12 luni, Contractantul să nu demareze activitățile care ar genera costuri, Autoritatea Contractantă nefiind ținută la plata niciunei despăgubiri în cazul desființării contractului. Precizăm că, în deplin acord cu principiul bunei-credințe, autoritatea contractantă depune toate diligențele administrative necesare pentru obținerea finanțării
