II.1.4 Descrierea succinta a contractului sau a achizitiei/achizitiilor Obiectul contractului il reprezinta proiectarea si executia Nodului Rutier Pantelimon (A0 - km 48) sectorul A0 Nord, in conformitate cu prevederile contractului de lucrari. In conformitate cu prevederile art. 160 alin. (1) din Legea nr. 98/2016 cu modificarile si completarile ulterioare, termenul limita pana la care orice operator economic interesat de participarea la procedura de achizitie publica are dreptul de a solicita clarificari sau informatii suplimentare in legatura cu documentatia de atribuire este cu 25 zile inainte de termenul limita de depunere a ofertelor. In conformitate cu prevederile art. 160 alin. (2) din Legea 98/2016 cu modificarile si completarile ulterioare, Autoritatea Contractanta stabileste un singur termen limita in care va raspunde tuturor solicitarilor de clarificare/ informatiilor suplimentare, dupa cum urmeaza: cu 12 zile inainte de termenul limita de depunere a ofertelor. Termenul de raspuns la clarificari a fost stabilit astfel incat operatorii economici sa aiba o perioada adecvata pentru analizarea documentatiei de atribuire si, ulterior, pentru elaborarea ofertelor prin prisma raspunsurilor oferite de Autoritatea Contractanta. Obiectul contractului il reprezinta proiectarea si executia Nodului Rutier Pantelimon (A0 - km 48) sectorul A0 Nord, in conformitate cu prevederile contractului de lucrari. In conformitate cu prevederile contractuale, respectiv ale H.G. nr.1/2018, eventualele modificari care pot interveni in perioada de derulare a contractului, se refera la urmatoarele, fara a se limita la acestea: 1. Modificari ale partilor contractante, inclusiv inlocuirea contractantului cu un nou contractant in conditiile prevazute la art. 221 alin. (1) lit. d), punctul (ii); 2. Schimbarea denumirii si/sau a formei societatii, schimbari care nu atrag crearea unei persoane juridice noi; 3. Modificari care rezulta din adaptarea Proiectului Tehnic de Execuție la realitatea din teren, inclusiv schimbări de soluții tehnice punctuale; 4. Modificari care rezulta din modificări/adaptări ale cotelor, pozițiilor și/ sau dimensiunilor unor lucrari ca urmare a situatiei din teren; 5. Modificari generate de cerinte ale autoritatilor de mediu; 6. Modificari care rezulta din necesitatea mutarii/stramutarii unor obiecte aflate pe/in sol/subsol; 7. Modificari generate de includerea de noi subcontractanti/ furnizori/ subcontractanții subcontractanților/ orice alți operatori economici si/sau generate de inlocuirea subcontractantilor/ furnizorilor/ subcontractanții subcontractanților/ orice alți operatori economici initiali, care se vor realiza conform clauzei corespunzatoare din Conditiile Generale ale Contractului; 8. Modificari generate de schimbarea personalului cheie/alt personal, care se vor realiza conform clauzei corespunzatoare din Conditiile Generale ale Contractului; 9. Modificari ale culoarului/coridorului de expropriere care conduc la necesitatea realizarii de lucrari suplimentare si/sau la renuntarea realizarii unor lucrari existente in Contract; 10. Modificari generate de acorduri, conventii, intelegeri ale statului/autoritatilor locale cu alte state; 11. Modificari legislative sau de norme tehnice/ stasuri/ normative/ standarde, pe parcursul derularii contractului, care se vor realiza conform clauzei corespunzatoare din Conditiile Generale ale Contractului, cu respectarea prevederilor art. 221 din Legea nr. 98/2016, cu modificarile si completarile ulterioare; 12. Prelungirea Duratei de Executie in baza mecanismului contractual prevazut la Clauza 35 [Prelungirea Duratei de Execuţie] din Conditiile Generale fara a se aduce atingere dreptului Beneficiarului de a aplica Antreprenorului penalitatile si/sau sanctiunile prevazute in contract; 13. Modificari care rezulta din implementarea solicitarilor provenite de la diverse institutii/autoritati/entitati care au atributii in legatura cu obiectivul de investitie (de exemplu: Ministere, JASPERS, Autoritati/Institutii centrale si/sau locale, Verificatori atestati, organisme de control, etc.). 14. Modificari care rezulta din descarcarea de sarcini arheologice. 15. Modificari generate de modificari ale terenului, retelei hidrografice supraterane si subterane necunoscute la data elaborarii Proiectului Tehnic de Execuție; Modificarile vor fi realizate ulterior semnarii contractului, in conformitate cu prevederile contractuale, numai in conditiile in care acestea nu reprezinta modificari substantiale in sensul prevederilor art. 221 alin. (7) din Legea nr. 98/2016. Prelungirea Duratei de Executie se va realiza in conformitate cu prevederile Clauzei 35 [Prelungirea Duratei de Executie] din Conditiile Generale.
