Achizitie produse destinate statiei de asfalt pentru fabricarea de mixturi asfaltice si produse conexe - Acord Cadru 4 ani - DRDP-Constanta. Produsele ce fac obiectul acordului cadru sunt urmatoarele: Aditiv fluxant vegetal pentru fabricare mixtura stocabila; Saci de polietilena pentru ambalare mixtura stocabila ; Solutie de curatare antiaderenta pe baza vegetala pentru amestecuri bituminoase; Polimeri predozati pentru fabricarea mixturilor asfaltice MASF; Valoare maxima acord cadru - 7.795.900,00 lei fara TVA, Valoare minima acord cadru - 779.590,00 lei fara TVA, Valoare celui mai mare contract subsecvent: 1.948.975,00 lei fara TVA. Valoarea celui mai mic contract subsecvent: 194.897,50 lei fara TVA. Frecventa si valoarea contractelor care urmeaza sa fie atribuite: minim 1 contract subsecvent in fiecare an al acordului cadru. Cantitatile minime si maxime aferente acordului cadru cat si cantitatile estimate minima si maxima aferente unui contract subsecvent se regasesc ca Anexe la documentatia de atribuire/caietul de sarcini. A)Numar de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor/candidaturilor:18 zile. B)Conform obligatiei prevazute la art.161 alin 1 din Legea 98/2016, modificata si completata, autoritatea contractanta va raspunde in mod clar si concret la toate solicitarile de clarificari in a 11-a zi dinainte de termenul limita stabilit pentru depunerea ofertelor. Orice solicitare de clarificare transmisa dupa data mentionata la punctul A), va pune autoritatea contractanta in imposibilitatea de a oferi un raspuns in termenul mentionat la punctul B) si drept urmare orice solicitare de clarificare in termenele mentionate se va considera tardiva. Autoritatea contractanta isi rezerva dreptul de a modifica contractele subsecvente potrivit art. 221 din Legea 98/2016 modificata si completata, cu conditia ca aceste modificari sa nu se incadreze in prevederile art. 221 alin. (7) din Legea 98/2016, modificata si completata, adica sa nu reprezinte modificari substantiale. Obiectul modificarilor:1.Modificari ale duratei de furnizare; 2.Modificari ale cantitatilor din contractele subsecvente numai in sensul scaderii acestora; 3.Modificari generate de cerinte ale autoritatilor de mediu; 4.Modificari generate de includerea de noi subcontractanti si/sau inlocuirea subontractantilor initiali; 5.Modificari generate de autoritati centrale/locale, cerute prin diverse avize/acorduri/autorizatii. Cauza modificărilor:- diverse cerinte ale autoritatii contractante-daca va fi cazul; - modificarea cantitatilor de produse din caietul de sarcini, fara modificarea valorii contractului; - prelungirea duratei de livrare;-introducere de subcontractanți în condițiile prevăzute de lege; Oportunitatea modificărilor:Pentru a nu bloca furnizarea produselor si ducerea la indeplinire a obiectului contractului subsecvent. Mecanismul propus pentru realizarea eventualelor modificări: Conform prevederilor contractuale legale. Orice modificare se va materializa intr-un Act Aditional la contract ce va fi semnat de Furnizor si Achizitor. Furnizorul/derulatorul notifica atunci cand constata neconcordante/ inconveniente care ar putea duce la intarzieri sau neefectuari ale livrarilor.
