1. Przedmiotem zamówienia jest usługa transportu sanitarnego pacjentów oraz dokumentacji medycznej. 2. Nazwa przedmiotu wg Wspólnego Słownika Zamówień: CPV 60130000-8- usługi transportowe. 3. Szczegółowy opis przedmiotu zamówienia, szacowane ilości oraz warunki, na jakich będzie realizowany przedmiot zamówienia, określają załączniki (Zał. nr 1 B - opis przedmiotu zamówienia, Zał. nr 6 - projekt umowy, Zał. nr 1 A - formularz oferty). 4. Wykonawca w ramach świadczonej usługi zobowiązany jest do stosowania i przestrzegania obowiązujących w przedmiocie zamówienia przepisów prawa, posiadać stosowne uprawnienia oraz ponosi pełną odpowiedzialność w przypadku ich naruszenia. 5. Na podstawie art. 95 ust. 1 ustawy Pzp, Zamawiający wymaga zatrudnienia przez Wykonawcę lub podwykonawcę na podstawie umowy o pracę w rozumieniu ustawy z dnia 26 czerwca 1974 r. Kodeks Pracy Kodeks pracy (Dz. U. z 2019 r. poz. 1040, 1043 i 1495) nieprzerwanie przez cały okres obowiązywania Umowy osoby/osób wykonujących czynności związane z realizacją przedmiotu zamówienia. 6. Najpóźniej przed zawarciem umowy, Wykonawca przekaże Zamawiającemu oświadczenie o spełnieniu wymogu, o którym mowa w ust. 5 tj. iż osoba/osoby wykonujące czynności związane z realizacją przedmiotu zamówienia będą zatrudnione na umowę o pracę w rozumieniu ustawy z dnia 26 czerwca 1974 r. Kodeks Pracy. 7. Zamawiający na każdym etapie realizacji umowy ma prawo do zweryfikowania oświadczenia wykonawcy/podwykonawcy (dot. formy zatrudnienia osób, o których mowa w ust. 5). W tym celu uprawniony jest w szczególności do zwrócenia się do właściwego inspektoratu pracy o przeprowadzenie kontroli. 8. Zamawiający nie zastrzega możliwości ubiegania się o zamówienie wyłącznie przez Wykonawców, o których mowa w art. 94 ustawy Pzp. 9. Zamawiający nie stawia wymagań, o których mowa w art. 96 ustawy pzp. 10. Wykonawca jest zobowiązany posiadać dobrowolne ubezpieczenie OC o wartości wskazanej w projekcie umowy. Najpóźniej przed zawarciem umowy, Wykonawca przekaże Zamawiającemu dokumenty potwierdzające spełnienie tego wymogu.
