Description

Con Determina del Sovrintendente del 9 luglio 2026, la Fondazione Lirico-Sinfonica Petruzzelli e Teatri di Bari ha deciso di affidare un accordo quadro ex art. 59 comma 3 D. lgs. n. 36/2023 avente ad oggetto il servizio di sartoria professionale e servizi accessori per gli spettacoli messi in scena dalla Fondazione nelle stagioni 2026 e 2027.L’affidamento avverrà mediante procedura aperta telematica e con applicazione del criterio dell’offerta economicamente più vantaggiosa individuata sulla base del miglior rapporto qualità/prezzo, ai sensi degli artt. 71 e 108 del Codice dei contratti pubblici di cui al Decreto legislativo 31 marzo 2023, n. 36 (nel prosieguo, Codice).L’individuazione dell’operatore economico aggiudicatario del servizio in oggetto avviene mediante procedura aperta in quanto le caratteristiche del mercato di riferimento inducono a ritenere preferibile un ampio confronto concorrenziale, tenuto conto del fatto che l’art. 48 comma 1 del Codice, sulla disciplina comune applicabile ai contratti sottosoglia, richiama accanto al principio del risultato tutti i principi contenuti nel titolo I della Parte I del Primo Libro del Codice, tra cui rilevano, in particolare, il principio di accesso al mercato degli operatori economici nel rispetto dei principi di concorrenza, di imparzialità, di non discriminazione, di pubblicità e trasparenza, di proporzionalità, e il principio della fiducia, che valorizza l’iniziativa e l’autonomia decisionale dei funzionari pubblici, dovendosi interpretare ed applicare le disposizioni contenute nell’art. 50 nel solco dei principi e delle regole della normativa di settore dell’Unione europea, che in particolare richiama gli Stati membri a prevedere la possibilità per le amministrazioni aggiudicatrici di applicare procedure aperte o ristrette, come disposto dalla direttiva 2014/24/UE.Pertanto, fermi restando i requisiti di ammissibilità, gli operatori economici possono partecipare alla procedura indicata in oggetto presentando apposita offerta.Con l’avvenuta partecipazione si intendono accettate e riconosciute tutte le modalità, le indicazioni e le prescrizioni previste dal presente disciplinare, alle condizioni di seguito esplicitate.Resta fermo che il presente disciplinare non costituisce presunzione di ammissibilità del concorrente e che la Fondazione può procedere all'esclusione del medesimo, anche in ragione di cause ostative non rilevate al momento della qualificazione o intervenute successivamente alla medesima.La Fondazione potrà procedere all’aggiudicazione della gara anche in presenza di una sola offerta valida, se ritenuta congrua e conveniente, e non è tenuta a corrispondere compenso alcuno ai concorrenti, per qualsiasi titolo o ragione, per le offerte presentate. In caso di sospensione e/o revoca e/o annullamento della presente procedura di gara oppure di mancata aggiudicazione o stipula del contratto per decisione motivata della Fondazione, gli offerenti o l’interessato all’aggiudicazione o alla stipula del relativo contratto non potranno vantare nei confronti della Fondazione stessa alcun diritto e/o pretesa a titolo risarcitorio o di indennizzo, ivi compreso qualsivoglia rimborso delle spese sostenute in ragione della partecipazione alla presente procedura.La documentazione di gara è pubblicata sul sito web istituzionale della Fondazione https://www.fondazionepetruzzelli.com nell’area “Amministrazione Trasparente - Sezione Bandi di gara e contratti - Bandi di gara telematici” e sulla piattaforma https://fondazionepetruzzelli.tuttogare.it.La durata del procedimento prevista è pari a nove mesi dalla pubblicazione del bando, salvo il verificarsi delle ipotesi di proroga previste all’art. 1 commi 4 e 5 dell’Allegato I.3 del Codice.La stazione appaltante è la Fondazione Lirico-Sinfonica Petruzzelli e Teatri di Bari, ente di diritto privato in controllo pubblico, con sede in Bari, alla Strada S.
