Description

Le marché est un marché global de performance passé en application de l'article L2171-3 du Code de la Commande Publique. Ce marché global de performance associe l'exploitation et la maintenance à la réalisation afin de remplir des objectifs chiffrés de performance. Également, la Ville recourt à ce type de contrat afin que le titulaire remplisse des objectifs chiffrés de performances. Ces objectifs sont définis notamment en termes de niveau d'activité, de qualité de service, d'efficacité énergétique. Ce marché global de performance comporte des engagements de performance mesurables. Ce marché étant un marché de services, il sera soumis aux règles du CCAG - Fournitures courantes et services. Comme le permet l'article R. 2124-3 4° et 5°, la Ville de Franqueville-Saint-Pierre recourt à la procédure avec négociation pour conclure ce marché. Il sera fait application des articles R.2161-12° à R.2161-23° du Code de la Commande Publique. S'agissant d'un marché global de performance, ce marché déroge au principe de l'allotissement (Art L.2171-1 du Code de la commande publique)
