Description

Gegenstand der Ausschreibung ist die Durchführung einer anlassbezogenen Sonderprüfung nach § 14 Abs. 2 Satz 2 KAGB bei einer Kapitalverwaltungsgesellschaft mit Erlaubnis nach dem Kapitalanlagegesetzbuch (KAGB). Gegenstand der Sonderprüfung ist die Beurteilung, ob die Kapitalverwaltungsgesellschaft die ihr nach dem KAGB obliegenden Sorgfalts-, Interessenkonfliktmanagement- und Risikomanagementpflichten ordnungsgemäß erfüllt hat. Die Prüfung umfasst insbesondere die Einhaltung der Pflichten aus § 26 Abs. 1 und 2, § 27 Abs. 1 bis 4, § 28 Abs. 1 sowie § 29 Abs. 2 und 3, § 30 Abs. 1 und 2 KAGB jeweils i.V.m. der Delegierten Verordnung (EU) Nr. 231/2013 und dem Bafin-Rundschreiben 01/2017 (WA) zu den Mindestanforderungen an das Risikomanagement für Kapitalverwaltungsgesellschaften (KAMaRisk).
