Description

Es handelt sich nicht um ein offenes Verfahren, sondern um ein sog. open-house-Modell! Das Formular für das offene Verfahren wird lediglich deshalb verwendet, da kein Formular für das open-house-Modell existiert. Verträge, die im open-house-Modell geschlossen werden, unterfallen mangels Auswahlentscheidung nicht dem Vergaberecht. Eine Unterwerfung unter vergaberechtliche Regelungen ist mit der Verwendung dieses Formulars nicht verbunden. Inhalt des Open House Verfahrens ist der Abschluss eines nicht-exklusiven Vertrags über die Versorgung mit patientenindividuell verordneten Verbandmitteln und sonstigen Produkten der Wundbehandlung (§ 31 Abs. 1a SGB V) im Sinne der Anlage Va und Medizinprodukten mit Verbandmittelcharakter nach Anlage V der Arzneimittelrichtlinie im Sinne des § 31 SGB V, soweit nicht apothekenpflichtig. Die Vertragsparteien schließen diesen Vertrag gemäß § 31 Abs. 1 Satz 2 SGB V i. V. m. §§ 126, 127 SGB V in der bis 10.05.2019 gültigen Fassung über die Versorgung der Versicherten der AOK mit patientenindividuell verordneten Verbandmitteln und sonstigen Produkten der Wundbehandlung, soweit die betreffenden Produkte nicht der Apothekenpflicht unterliegen. Der Vertrag dient der Erfüllung des Anspruchs der Versicherten nach § 31 Abs. 1 Sätze 1 und 2 SGB V i. V. m. den Richtlinien nach § 92 Abs. 1 Satz 2 Nr. 6 SGB V. Ziel der Vertragsparteien ist es, die qualitativ hochwertige und wirtschaftliche Versorgung der Versicherten mit den vertragsgegenständlichen Produkten zu gewährleisten und für alle Beteiligten klare, einheitliche und rechtssichere Bedingungen zu schaffen. Der frühestmögliche Vertragsbeginn ist der 01.02.2026, alle Verträge enden spätestens am 31.01.2030. Die Laufzeit ist auf vier Jahre begrenzt, ein Vertragsschluss ist während der Laufzeit jederzeit zum ersten eines Monats möglich, spätestens jedoch am 20.12.2029. Für einen Vertragsstart zum nächsten Monatsersten, müssen die Unterlagen bis spätestens zum 20. des Vormonats mittels qualifizierter elektronischer Signatur an die E-Mail-Adresse vertrag-SLE@by.aok.de oder unterschrieben per Post bei der unten genannten Kontaktstelle eingehen. Zur Teilnahme am frühestmöglichen Vertragsbeginn 01.02.2026 müssen die Unterlagen bis spätestens 20.01.2026 vollständig mittels qualifizierter elektronischer Signatur an die E-Mail-Adresse vertrag-SLE@by.aok.de oder unterschrieben per Post bei der unten genannten Kontaktstelle eingehen. Der Vertrag kann von jedem Vertragspartner ordentlich mit einer Frist von einem Monat zum Quartalsende gekündigt werden. Die AOK kann die Verträge nur einheitlich gegenüber allen Vertragspartnern kündigen. Ihr Recht auf außerordentliche Kündigung bleibt unberührt. Vor Vertragsstart müssen die Leistungserbringer die unter Pkt. II aufgeführten Nachweise fristgerecht bei der Vergabestelle der AOK Bayern einreichen. Ein von der AOK gegengezeichnetes Exemplar wird an den Leistungserbringer zurückgesandt. II. Einzureichende Unterlagen Unterlagen, die nicht in deutscher Sprache abgefasst sind, müssen mit einer deutschen Übersetzung eingereicht werden. Ein Vertrag wird mit allen geeigneten und interessierten Leistungserbringern geschlossen, die ihre Eignung wie folgt nachweisen: 1. Vom Leistungserbringern ausgefüllter und unterzeichneter Vertrag in zweifacher Ausfertigung nebst Anlagen (die Vertretungsberechtigung des/der Unterzeichner/s muss sich aus dem Handelsregisterauszug ergeben, anderenfalls ist eine Vollmacht vorzulegen). 2. Ausgefüllte und unterschriebene Zuverlässigkeitserklärung (Anlage 2 des Vertrages) Die Unterlagen können ENTWEDER in SCHRIFTFORM von Hand unterzeichnet ODER ELEKTRONISCH mit einer qualifizierten elektronischen Signatur eingereicht werden. Von Hand unterzeichnete Unterlagen in SCHRIFTFORM sind in 2-facher Fassung im Original an folgende Adresse einzusenden: AOK Bayern - Die Gesundheitskasse Bereich Arzneimittelversorgung "Open-House-Vertrag Verbandstoffe" Carl-Wery-Str. 28 81739 München ELEKTRONISCHE Unterlagen mit einer qualifizierten elektronischen Signatur sind an die E-Mail-Adresse vertrag-SLE@by.aok.de einzureichen. Bei Eingang vollständiger und korrekter Unterlagen bis zum 20. eines jeden Monats erfolgt der Vertragsbeginn zum darauffolgenden nächsten Monatsersten, ansonsten zum darauffolgenden übernächsten Monatsersten. Bei von Hand unterzeichneten Unterlagen in SCHRIFTFORM hat eine Übersendung bis zum 20. eines jeden Monats der vollständigen, ausgefüllten und unterzeichneten Unterlagen vorab als Scan an die E-Mail-Adresse vertrag-SLE@by.aok.de fristwahrend für einen Vertragsbeginn zum ersten des darauffolgenden Monats zu erfolgen. siehe kurze Beschreibung
