Description

Die vorliegende Bekanntmachung dient dem Abschluss von Vereinbarungen zu Blutzuckerteststreifen mit Unternehmen oder Auftragsnehmergemeinschaften von Unternehmen im Sinne von § 130a Abs. 8 Satz 1 Sozialgesetzbuch Fünftes Buch (SGBV) (Rabattverträge) für das Bundesland Nordrhein-Westfalen. Es handelt sich nicht um ein Offenes Verfahren, sondern um eine Veröffentlichung der Aufforderung zum Abschluss/Beitritt von/zu Rabattverträgen mit für alle Teilnehmer festgelegten und nicht verhandelbaren Konditionen. Vertragspartner können unbegrenzt viele Unternehmer oder Auftragsnehmergemeinschaften von Unternehmern werden. Der Vertragsabschluss oder ein Beitritt erfolgt, indem die geforderten Eigenerklärungen bzw. Nachweise sowie der Vertrag bzw. die Verträge entweder a) handschriftlich unterschrieben (Schriftform nach § 126 BGB) per Post oder b) mit einer qualifizierten elektronischen Signatur versehen per E-Mail (vergabestelle@kbs.de) an die KBS gesandt werden. Frühester Vertragsbeginn ist der 01.08.2025, sofern der unterschriebene Vertrag und die geforderten ausgefüllten Erklärungen beziehungsweise Nachweise spätestens am 05.07.2025 bei der KBS eingegangen sind. Bei späterem Eingang ist Vertragsbeginn der jeweils erste des Monats, der auf den Monat des Eingangs des formgültig ausgefüllten Vertrages sowie der geforderten Erklärungen beziehungsweise Nachweise bei der KBS folgt, sofern der Eingang bis zum jeweils fünften eines Monats erfolgt; ansonsten der jeweils erste des übernächsten Monats. Die Verträge enden automatisch, ohne dass es einer Kündigung bedarf, sobald für die vertragsgegenständlichen Blutzuckerteststreifen Vertragspartner im Wege eines formellen Vergabeverfahrens feststehen. Schlusstermin für den Eingang von Beitritten ist der 05.06.2027. In jedem Fall enden die Verträge am 31.07.2027.
