Description

Das Landesamt für Zentrale Polizeiliche Dienste Nordrhein-Westfalen beabsichtigt, im Zuge des vorliegenden Offenen Verfahrens mit einem Wirtschaftsteilnehmer eine Rahmenvereinbarung über die Lieferung von blauen Pullovern für die Einsatzkräfte der Polizei des Landes Nordrhein-Westfalen abzuschließen. Der blaue Pullover ist Teil der Dienstkleidung für Damen und Herren. An die Bekleidung werden besondere Anforderungen gestellt. Daher muss die Bekleidung die Technischen Lieferbedingungen TLP 4500, Ausgabe 4 (Kapitel B1) und TLP 9906, Ausgabe 3 (Kapitel B2) der Polizei des Landes NRW, die Bestandteil dieser Ausschreibungsunterlagen sind, erfüllen. Im Hinblick auf die Rahmenvereinbarung werden keine Mindestabnahmemengen vereinbart. Nach Rechtsprechung des EuGH vom 17.06.2021 _ RS C - 23/20 - ist der Auftraggeber zur Sicherung der Transparenz und Diskriminierungsfreiheit im Wettbewerb dazu verpflichtet, eine Höchstmenge anzugeben. Eine Abrufverpflichtung kann daraus nicht abgeleitet werden. Der Auftraggeber schätzt, dass über die gesamte Vertragslaufzeit ein Bedarf an ca. 48.000 Pullovern besteht. Die Höchstmenge der anliegenden Rahmenvereinbarung wird mit 62.400 Pullovern beziffert. Die Rahmenvereinbarung endet ohne dass es einer Kündigung bedarf, je nachdem welches Ereignis früher eintritt, mit dem Ablauf der Laufzeit der Rahmenvereinbarung (Mindestlaufzeit bei Betätigung des Kündigungsrechts durch den Auftraggeber, oder Maximallaufzeit bei fehlender Kündigung des Auftraggebers) oder bei Erreichen der Höchstmenge.
