Description

Die TK verfolgt das Ziel, mit allen geeigneten pharmazeutischen Unternehmern Rabattverträge nach § 130c Abs. 1 SGB V zur Wirkstoffkombination Emtricitabin/Tenofovirdisoproxil/Rilpivirin zu schließen. Der Vertragsschluss erfolgt im Rahmen des Open-House-Originale-Verfahrens der TK: Individuelle Verhandlungen über Vertragsinhalte werden nicht geführt, es gelten einheitliche Konditionen. Die TK sichert einzelnen Vertragspartnern keine Exklusivität zu. Die Vertragslaufzeit beträgt maximal 24 Monate beginnend mit dem 01.03.2025. Der Vertrag endet spätestens am 28.02.2027, unabhängig vom Datum des Vertragsschlusses. Bei Patentablauf/Ablauf der Marktexklusivität vor dem o.g. Enddatum endet der Vertrag automatisch mit Ablauf des Monats des Patentablaufs/der Marktexklusivität. Ein Beitritt zu diesem Open-House-Originale-Verfahren ist innerhalb der Vertragslaufzeit jederzeit möglich. Aufgrund des Bestehens von gewerblichen Schutzrechten im Hinblick auf den vertragsgegenständlichen Wirkstoff bzw. die verfahrensgegenständliche Wirkstoffkombination werden die Teilnahme- und Vertragsunterlagen nur solchen pharmazeutischen Unternehmern zur Verfügung gestellt, die Arzneimittel zu dem verfahrensgegenständlichen Wirkstoff bzw. der verfahrensgegenständlichen Wirkstoffkombination anbieten/inverkehrbringen bzw. gegenüber der TK glaubhaft machen, solche Arzneimittel innerhalb der Vertragslaufzeit anbieten/inverkehrbringen zu wollen.
