Description

Gegenstand dieser Veröffentlichung ist der Abschluss von nicht exklusiven Rabattverträgen gemäß § 130a Abs. 8 SGB V zu Fertigarzneimitteln mit dem Wirkstoff Natalizumab (ATC: L04AG03) im Rahmen eines sogenannten "open-house-Modells". Unter Vorgabe einheitlicher Vertragskonditionen sowie eines einheitlichen Zugangsverfahrens wird allen geeigneten und interessierten pharmazeutischen Unternehmen oder Gemeinschaften pharmazeutischer Unternehmen der Abschluss bzw. Beitritt zu einem Rabattvertrag nach § 130a Abs. 8 SGB V zu den vorgenannten Wirkstoffen bzw. Arzneimitteln angeboten. Interessierte pharmazeutische Unternehmen können dazu bei der genannten Kontaktadresse die Teilnahmeunterlagen sowie den jeweiligen Vertrag anfordern. Voraussetzung für den Abschluss eines Vertrages ist, dass das interessierte pharmazeutische Unternehmen die angeforderten Teilnahmeunterlagen vollständig ausgefüllt und unterzeichnet. Abschluss nicht-exklusiver Rabattvereinbarungen gemäß § 130a Abs. 8 SGB V zu Fertigarzneimitteln mit dem Wirkstoff Natalizumab (ATC: L04AG03) bei jederzeitiger Abschlussmöglichkeit im Rahmen eines sogenannten "open-house-Modells". Mit jedem pharmazeutischen Unternehmen, das die Teilnahmevoraussetzungen erfüllt, wird ein Vertrag abgeschlossen. Eine Exklusivität ist nicht gegeben. Der Beitritt bzw. der Vertragsabschluss kann jederzeit und zu den gleichen Bedingungen erfolgen. Individuelle Vertragsverhandlungen werden nicht durchgeführt. Der früheste Vertragsbeginn ist der 01.10.2026. Davon ausgehend beträgt die Vertragslaufzeit maximal 24 Monate. Der Vertrag endet am 30.09.2028 unabhängig von dem Beginn des Vertrages. Sollte die AOK Sachsen-Anhalt während der Vertragslaufzeit nach Maßgabe der einschlägigen vergaberechtlichen Vorschriften Exklusivverträge für die Wirkstoffe ausschreiben, werden die im Rahmen dieser Veröffentlichung geschlossenen Verträge entsprechend den vertraglichen Regelungen beendet. Bei der vorliegenden Veröffentlichung handelt es sich nicht um die Vergabe eines öffentlichen Auftrags im Sinne des § 103 GWB bzw. des Vergaberechts. Um ein weitestgehendes Maß an Transparenz für die beabsichtigten Vertragsabschlüsse zu gewährleisten, erfolgt die Veröffentlichung im Supplement zum Amtsblatt der Europäischen Union. In Ermangelung eines entsprechenden Veröffentlichungsformulars wird die Auftragsbekanntmachung genutzt. Die daraus resultierenden begrifflichen Vorgaben, wie bspw. die Verfahrensbezeichnung "offenes Verfahren", sind einzig der Nutzung dieses Bekanntmachungsformulars und der Veröffentlichungsplattform geschuldet. Eine weitere Bedeutung, insbesondere eine Unterwerfung unter vergaberechtliche Regelungen, soweit sie nicht aus rechtlichen Gründen verpflichtend sind, ist damit nicht verbunden.
