Description

Sammeln und Fortleiten der im Gebiet des Zweckverbandes Technologiepark Mitteldeutschland anfallenden Abwässer in die Kläranlagen des Abwasserzweckverbandes Westliche Mulde (AZV) Der AZV ist gem. § 78 Wassergesetz LSA in Verbindung mit § 83 Wassergesetz LSA verpflichtet, die auf seinem Gebiet anfallenden Abwässer zu beseitigen. Zur Erfüllung der Teilaufgaben der Schmutzwasserentsorgung "Sammeln und Fortleiten" bedient sich der AZV für das Gebiet des Zweckverbandes Technologiepark Mitteldeutschland der Konzessionärin, die im eigenen Namen und auf eigene Rechnung auf der Grundlage dieses Vertrages im Bereich der Abwasserbeseitigung tätig wird. Insofern ist die Konzessionärin Dritte im Sinne des § 78 Abs. 1 Satz 4 WG-LSA; die öffentlich-rechtlichen Abwasserbeseitigungspflichten verbleiben weiterhin bei dem AZV. Dieser hat eine Abwasserbeseitigungssatzung mit Anschluss- und Benutzungszwang erlassen, welche auch das vertragsgegenständliche Gebiet umfasst.
