Description

Předmětem veřejné zakázky je poskytování služby provozování sběrného dvora města Dobrušky (dále jen „sběrný dvůr“) umístěného v ulici Čs. odboje v Dobrušce, a to po dobu neurčitou s předpokládaným dnem zahájení faktického provozování sběrného dvora od 01.01.2027. Sběrný dvůr bude vybraným dodavatelem jako provozovatelem provozován jako zařízení určené pro nakládání s odpady ve smyslu ust. § 11 odst. 1 písm. r) bod 1. zákona č. 541/2020 Sb., o odpadech, ve znění pozdějších předpisů (dále jen „zákon o odpadech“). Poskytování služby provozování sběrného dvora zahrnuje výkon činností uvedených ve Smlouvě o provozování sběrného dvora, která bude uzavřena s vybraným dodavatelem, a to za podmínek v této smlouvě uvedených. Vzor Smlouvy o provozování sběrného dvora tvoří přílohu č. 1 zadávací dokumentace. Sběrný dvůr je specifikován ve Smlouvě o nájmu sběrného dvora a její příloze č. 1, která bude s vybraným dodavatelem uzavřena společně se Smlouvou o provozování sběrného dvora. Na základě této Smlouvy o nájmu sběrného dvora bude sběrný dvůr předán vybranému dodavateli do užívání. Vzor Smlouvy o nájmu Sběrného dvora včetně její přílohy č. 1 tvoří přílohu č. 2 zadávací dokumentace. Součástí poskytované služby provozování sběrného dvora je mimo jiné i zajištění povolení k provozování sběrného dvora jakožto zařízení určeného pro nakládání s odpady dle § 21 odst. 2 zákona o odpadech umožňujícího vybranému dodavateli jako provozovateli provozování sběrného dvora jeho jménem v rozsahu a dle podmínek Smlouvy o provozování sběrného dvora, resp. zajištění potřebné změny stávajícího povolení, pokud již vybraný dodavatel jako provozovatel sběrný dvůr pro zadavatele provozoval bezprostředně před nabytím účinnosti Smlouvy o provozování sběrného dvora a je držitelem platného povolení pro jeho provozování.
