CONFORM CAIET DE SARCINI Realizarea procesului de achizitie publica pentru atribuirea acestui contract se va derula cu utilizarea resurselor profesionale existente la nivelul Spitalului de Clinic de Urgenta pentru Copii “Sf. Ioan” Galati. Finalizarea procedurii de atribuire prin încheierea acordului cadru, este supusa urmatoarei conditii: Clauza suspensiva: Procedura de atribuire a acordului cadru a fost initiata sub incidenta prezentei clauze suspensive, in sensul ca: - Incheierea contractului subsecvent este conditionata de obtinerea/aprobarea finantarii din fonduri bugetare [bugetul de stat/local , fonduri proprii ] si /sau fonduri europene nerambursabile, semnarea contractului fiind posibila doar in situatia in care se respecta dispozitiile referitoare la angajarea cheltuielilor din bugetele care intra sub incidenta legislatiei privind finatele publice. - In cazul în care, indiferent de motive, nu va fi aprobată finanțarea astfel încât autoritatea contractantă să dispună de fondurile necesare, autoritatea contractantă va aplica prevederile art. 212 alin.(1) lit. c) teza a II-a din Legea nr. 98/2016, fiind imposibilă încheierea contractului de achiziție publică. Perioada maximă pentru care operează clauza suspensivă este de 36 luni.
