Achizitia se realizeaza pe loturi. Lot 1 - Servicii de proiectare, verificare tehnică, asistență tehnică din partea proiectantului şi execuţia lucrărilor de construcţii-montaj aferente investitiei de baza - Corp C1 - Școala Lot 2 - Servicii de proiectare, verificare tehnică, asistență tehnică din partea proiectantului şi execuţia lucrărilor de construcţii-montaj aferente investitiei de baza - Corp C2 - Sală de sport Numărul de zile până la care se pot solicita clarificări înainte de data limita de depunere a ofertelor: 18 zile. Autoritatea contractantă va răspunde la solicitarile de clarificari cu 11 zile inainte de data limita de depunere a ofertelor. Servicii de proiectare, verificare tehnica, asistență tehnică din partea proiectantului şi execuţia lucrărilor de construcţii-montaj aferente investitiei de baza din cadrul proiectului Eficientizare energetică Liceul Tehnologic Dimitrie Dima: Corp C1 și Sală de sport - Corp C2 - SMIS 363255 Prezenta procedură este iniţiată cu clauză suspensivă Procedura de atribuire/achiziţia este iniţiată sub incidenţa clauzei suspensive, în sensul că încheierea contractului de achiziție publică este condiționată de încheierea contractului de finanțare a proiectului „Eficientizare energetică Liceul Tehnologic Dimitrie Dima: Corp C1 și Sală de sport - Corp C2 - SMIS 363255”, semnarea contractului făcându-se cu respectarea dispozițiilor referitoare la angajarea cheltuielilor din bugetele care intră sub incidenţa legislaţiei privind finanțele publice. Având în vedere dispoziţiile Legii nr. 98/2016 şi HG nr. 395/2016 cu modificările şi completările ulterioare, Autoritatea Contractantă precizează că va încheia contractul cu ofertantul declarat câștigător numai în măsura în care fondurile necesare achiziţiei vor fi asigurate prin semnarea contractului de finanţare în cadrul PRSM 2021-2027 cu Agenţia pentru Dezvoltare Regională (ADR) Sud- Muntenia. În cazul în care, indiferent de motive, contractul de finanțare nu se va semna, Autoritatea Contractantă, după primirea notificării din partea Agenţiei pentru Dezvoltare Regională (ADR) Sud-Muntenia cu privire la neacordarea finanțării, îşi rezervă dreptul de a anula procedura de atribuire, în condiţiile în care nu există o altă sursă de finanţare, în conformitate cu prevederile art. 212 alin (1) lit. c) teza 2 din Legea nr. 98/2016 cu modificările şi completările ulterioare, fiind imposibilă încheierea contractului de achiziție publică. Ofertanţii din cadrul acestei proceduri înțeleg că Autoritatea Contractantă şi/sau Agenţia pentru Dezvoltare Regională (ADR) Sud- Muntenia ce asigură finanțarea nu pot fi considerate răspunzătoare pentru vreun prejudiciu în cazul anulării procedurii de atribuire, indiferent de natura acestuia şi indiferent dacă Autoritatea Contractantă şi/sau Agenţia pentru Dezvoltare Regională (ADR) Sud- Muntenia au fost notificate asupra existenţei unui asemenea prejudiciu. Ofertanţii din cadrul acestei proceduri acceptă utilizarea condițiilor speciale de mai sus/a clauzei suspensive, asumându-și întreaga răspundere în raport cu eventualele prejudicii pe care le-ar putea suferi în situația descrisă. În aplicarea clauzei suspensive menționate, în cazul în care decizia de finanțare nu este emisă până la data expirării perioadei inițiale de valabilitate a ofertei, Autoritatea Contractantă are dreptul de a solicita contractantului prelungirea perioadei de valabilitate a ofertelor și în mod corespunzător a garanției de participare. Ofertanții au obligația de a răspunde solicitării în termenul indicat de Autoritatea Contractantă, răspunsul negativ sau lipsa unui răspuns în termenul solicitat atrăgând imposibilitatea semnării contractului, oferta respectivă fiind considerată retrasă, fără ca acest fapt să atragă executarea garanției de participare.; Servicii de proiectare, verificare tehnică, asistență tehnică din partea proiectantului şi execuţia lucrărilor de construcţii-montaj aferente investitiei de baza - Corp C1 - Lot 1 din cadrul proiectului Eficientizare energetică Liceul Tehnologic Dimitrie Dima: Corp C1 și Sală de sport - Corp C2 - SMIS 363255.
