Description

1. Przedmiotem postępowania jest Kompleksowa dostawa gazu ziemnego wysokometanowego typu E do budynków Gminy Mogilany i jej jednostek organizacyjnych. 2. Kompleksowa dostawa gazu będzie się odbywać na podstawie umowy zawierającej postanowienia umowy sprzedaży i umowy o świadczenie usług przesyłania lub dystrybucji gazu (umowa kompleksowa) i będzie wykonywana zgodnie z przepisami Ustawy z dnia 10 kwietnia 1997 r. - Prawo energetyczne (t.j. Dz. U. z 2026 r. poz. 43 z późn. zm.) dalej Prawo energetyczne, Ustawy z dnia 23 kwietnia 1964 r. Kodeks cywilny (t.j. Dz. U. z 2026 r. poz. 795) oraz przepisami wykonawczymi wydanymi na ich podstawie. 3. Szacunkowe zapotrzebowanie gazu ziemnego w okresie od 01.01.2027 r. do 31.12.2028 r. wynosi 5 651 000 kWh. Powyższa wartość jest szacunkowa, podana w celu określenia wartości zamówienia, co nie odzwierciedla realnego bądź deklarowanego poboru gazu ziemnego w czasie trwania umowy i w żadnym razie nie może być podstawą jakichkolwiek roszczeń ze strony Wykonawcy. Zamawiający zastrzega sobie możliwość zmniejszenia lub zwiększenia ilości gazu. Obecnym operatorem Systemu Dystrybucyjnego jest Polska Spółka Gazownictwa Sp. z o.o. 4. Na koszty korzystania z przedmiotu Zamówienia składać się będą: opłata za sprzedaż gazu, opłata abonamentowa, opłata dystrybucyjna stała oraz opłata dystrybucyjna zmienna. Odbiorca zakwalifikowany jest przez właściwy dla niego system dystrybucyjny (OSD) do grup taryfowych z oznaczeniami W-1.1, W-2.1., W-3.12, W-3.6., W-4., W-5. 5. Szczegółowy opis przedmiotu zamówienia wraz z wykazem punktów poboru gazu ziemnego zawarty jest w Załączniku nr 9 oraz w Załaczniku nr 9.1 do opisu przedmiotu zamówienia. Deklarowane w w/w załącznikach zużycie gazu jest wielkością szacunkową i służy wyłącznie do obliczenia ceny Oferty.
