Description

Voor deze opdracht kan op grond van de Aanbestedingswet 2012 worden afgeweken van de reguliere aanbestedingsprocedures. Conform het provinciale inkoop- en aanbestedingsbeleid en de Gids Proportionaliteit zou in beginsel een Europese aanbesteding moeten plaatsvinden. Artikel 1.4 van de Aanbestedingswet 2012 biedt echter ruimte om hiervan in uitzonderlijke situaties, op basis van objectieve criteria, gemotiveerd af te wijken. In dit geval wordt een beroep gedaan op artikel 2.31, eerste lid, onder b, van de Aanbestedingswet 2012, dat directe gunning toestaat wanneer om technische redenen geen daadwerkelijke mededinging mogelijk is. De uitvoering van de opdracht vereist specifieke gebiedsgebonden expertise, unieke datasets en methodologische continuïteit die exclusief beschikbaar zijn bij de terreinbeherende organisaties (TBO’s) die verantwoordelijk zijn voor het beheer van de betreffende Natura 2000-gebieden. Aangezien per Natura 2000-gebied, of deel van een Natura 2000-gebied slechts één TBO verantwoordelijk is voor het beheer, is het objectief onmogelijk de benodigde input bij andere partijen te verkrijgen. Hierdoor ontbreekt feitelijke mededinging. Dit is een vrijwillige transparantie vooraf in het kader van de jurisprudentie van het Hof van Justitie van de EU (zaak C-26/03 - Stadt Halle). Indien u bezwaar heeft tegen dit voornemen, kunt u dit kenbaar maken binnen 20 kalenderdagen na publicatie van deze aankondiging. Na het verstrijken van deze termijn zal de aanbestedende dienst overgaan tot definitieve gunning van de opdracht.
