Description

Er wordt een beroep gedaan op artikel 2.32 AW, lid 1, sub b, onder 2: geen mededinging om technische complexiteit en financiële redenen. Gemeente Helmond heeft een huidige overeenkomst met Visma Circle B.V. en wil die voortzetten. De gemeente Helmond heeft voorafgaand aan deze aankondiging een marktverkenning uitgevoerd waarbij geconcludeerd is dat in de gegeven omstandigheden feitelijk slechts één partij de opdracht kan uitvoeren zonder onaanvaardbare risico’s voor de continuïteit van de dienstverlening. Het migratietraject en de daaraan verbonden (hoogte van de) migratie- en transitiekosten leiden tot een bijzondere omstandigheid dat er van een redelijk alternatief of substituut geen sprake is. Een eventuele wisseling van software programmatuur brengt grote risico's en consequenties voor de continuïteit van de dienstverlening naar de burgers en voor de organisatie qua capaciteit, werkwijze en daarmee ook extra werklast met zich mee. Zie bijlage motivering. initiële looptijd 3 jaar met jaarlijkse verlengingsopties.
