Description

1/ La consultation est décomposée en quatre lots ci-après énoncés : Lot 1 Prestations de maintenance des trains travaux ; Lot 2 Prestations de maintenance des balayeuses rail route ; Lot 3 Prestations de maintenance des pelles rail route ; Lot 4 Prestations de maintenance des chariots autonomes. 2/ Les présents marchés publics sont passés selon une procédure avec négociation, en application des articles L2124-3, R2124-4 et R2161-21 à R2161-23 du Code de la commande publique. Il s'agit d'accords-cadres au sens des articles L2125-1.1° et R2162-2 et suivants du Code. Chaque accord-cadre est conclu avec un seul opérateur économique et exécuté en partie par l'émission de bons de commande, pour les prestations décrites dans les documents contractuels et en partie par la conclusion de marchés subséquents pour les besoins dont toutes les stipulations contractuelles ne sont pas fixées dans les documents de l'accord-cadre. 3/ En application de l'article R2162-4 du Code, les marchés publics sont conclus sans montant minimum d'engagement et avec un montant maximum d'engagement sur leur durée (5 ans), à savoir : Lot 1 : 8 500 000 euros HT ; Lot 2 : 500 000 euros HT ; Lot 3 : 1 000 000 euros HT ; Lot 4 : 1 000 000 euros HT. 4/ Il s'agit de marchés publics de services qui se réfèrent au Cahier des Clauses Administratives Générales applicable aux marchés publics de fournitures courantes et de services (CCAG/FCS), approuvé par l'arrêté du 30 mars 2021. 5/ La durée de chaque accord-cadre est de cinq ans ferme, à compter de sa date de notification. En application de l’article R2162-4 du Code, le lot 1 est conclu sans montant minimum d’engagement et avec un montant maximum d’engagement sur cinq ans de 8 500 000 euros HT.; En application de l’article R2162-4 du Code, le lot 2 est conclu sans montant minimum d’engagement et avec un montant maximum d’engagement sur cinq ans de 500 000 euros HT.; En application de l’article R2162-4 du Code, le lot 3 est conclu sans montant minimum d’engagement et avec un montant maximum d’engagement sur cinq ans de 1 000 000 euros HT.; En application de l'article R2162-4 du Code, le lot 4 est conclu sans montant minimum d'engagement et avec un montant maximum d'engagement sur cinq ans de 1 000 000 euros HT.
