Description

Constituye el objeto del presente contrato mixto el suministro de 21 columnas/tótems, equipadas con desfibriladores semiautomáticos, (DESAS), su instalación en diversos espacios públicos de la Ciudad de Madrid, y su mantenimiento integral. El contrato comprende las siguientes prestaciones: 1. Prototipo y homologación: Propuesta de prototipo a la Dirección general de SAMUR Protección Civil y tramitación para su homologación ante los órganos competentes del Ayuntamiento de Madrid. 2. Suministro e instalación: Ubicación de las columnas desfibriladoras en las localizaciones designadas, incluyendo toda la obra civil o anclaje necesario para su correcta fijación y operatividad en la vía pública. 3. Sistema de comunicación y emergencia: Integración en cada equipo de los dispositivos de comunicación bidireccional necesarios para contactar inmediatamente y en tiempo real con el Servicio de Emergencias 112 de la Comunidad de Madrid. 4. Dotación y señalética: Suministro de todo el material fungible y complementario necesario para el uso de los desfibriladores (parches, baterías, etc.) y la colocación de la señalética oficial y homologada conforme a la normativa autonómica, específicamente el Decreto 78/2017 de la Comunidad de Madrid, que regula el uso de desfibriladores fuera del ámbito sanitario. 5. Mantenimiento integral: Prestación del servicio de mantenimiento preventivo, correctivo y técnico de los equipos, asegurando su operatividad permanente, la reposición de consumibles por caducidad o uso, y la asistencia técnica continuada. Naturaleza mixta: El presente contrato tiene carácter mixto de conformidad con el artículo 18 de la Ley de Contratos del Sector Público (LCSP), al fusionar de forma vinculada prestaciones propias del contrato de suministros y del contrato de servicios. Determinación de la prestación principal: De acuerdo con lo establecido en el artículo 18.1.a) de la LCSP, se hace constar expresamente que la prestación principal del contrato es la de SUMINISTRO, al ser la que presenta un mayor valor estimado. Por otra parte, y tal y como asimismo se establece en el artículo 18 de la LCSP, debe tenerse en cuenta que los efectos, cumplimiento y extinción del contrato, deben determinarse de conformidad con el artículo 122.2 de dicho texto legal. A estos efectos, al ser el suministro la prestación principal, la preparación y adjudicación de este contrato mixto se regirán por las normas aplicables a los contratos de suministros. No obstante, para su ejecución y extinción, se aplicarán a cada una de las prestaciones las normas específicas de su respectiva naturaleza (Suministros y Servicios, respectivamente) contenidas en la LCSP y en los Pliegos que rigen el contrato.
