Description

Die Stadt Herzogenaurach ist aufgrund von § 88 Abs. 3 der Zuständigkeitsverordnung (ZustV) vom 16. Juni 2015 für die Verfolgung und Ahndung von Ordnungswidrigkeiten nach § 24 des Straßenverkehrsgesetzes (StVG) in gleicher Weise zuständig wie die Dienststellen der Bayerischen Landespolizei. Die Stadt führt die Geschwindigkeitsüberwachung im übertragenen Wirkungskreis nach Maßgabe der für die polizeiliche Geschwindigkeitsüberwachung geltenden Vorschriften durch. Der Umfang der Überwachung des fließenden Verkehrs bestimmt sich nach der Vereinbarung über die Überwachung der zulässigen Geschwindigkeit von Fahrzeugen mit dem zuständigen Polizeipräsidium Mittelfranken. Dazu wird die Überlassung von Arbeitnehmern gem. AÜG und die Zurverfügungstellung der Technik für die Durchführung der Überwachung des fließenden Verkehrs einschließlich der Durchführung des Innendienstes zum Zwecke der Prävention/Verhütung von Gefahren im Straßenverkehr ausgeschrieben.
