Beschaffung von Lizenzen SAP Cloud ERP Die Beauftragung erfolgte im Verhandlungsverfahren ohne Teilnahmewettbewerb gemäß § 14 Abs. 4 Nr. 2 b VgV, da der Auftrag aus technischen Gründen nur von der SAP SE erbracht werden kann und kein Wettbewerb besteht. Die benötigten SAP?Standardlizenzen für das SAP Cloud ERP sind urheberrechtlich geschützt und dürfen ausschließlich durch die SAP SE bzw. deren autorisierte Vertriebsorganisation bereitgestellt und lizenziert werden. Die Erneuerung der SAP Systemlandschaft erfordert Original SAP Lizenzen und den dazugehörigen SAP Enterprise Support, der nur durch SAP selbst erbracht werden kann. Ein anderer Anbieter ist rechtlich und technisch nicht in der Lage, die erforderlichen Lizenzen und Wartungsleistungen zu liefern, sodass ein wettbewerbliches Vergabeverfahren objektiv keinen Anbieterwettbewerb erzeugen könnte
