Die Errichtung, der Betrieb und die Finanzierung der Windenergieanlage erfolgen durch den Vertragspartner auf eigenes unternehmerisches Risiko. Der Optionsvertrag gewährt der Gemeinde lediglich das Recht, sich nach vollständiger und betriebsbereiter Errichtung bis zu 100 % an der Betreibergesellschaft zu beteiligen; eine Verpflichtung zur Ausübung der Option oder zur Übernahme der Anlage besteht nicht.
