Rahmenvereinbarung über das Leasing von Diensträdern für eine Laufzeit von 48 Monaten (inkl. 12- monatiger Verlängerungsoption) Diese Leistungsbeschreibung entspricht einer Rahmenvereinbarung zwischen der Stadt Gelsenkirchen (Leasingnehmerin/AG) und dem Auftragnehmer (Leasinggeber/AN). Gegenstand ist die Bereitstellung von Fahrrädern im Wege des Leasings (Teilamortisierungsleasing) in Form einer Entgeltumwandlung zum Zwecke der Überlassung an Mitarbeitende der Leasingnehmerin zur dienstlichen und privaten Nutzung (nachfolgend: Leasinggegenstände) einschließlich Versicherungs-, Schulungs- und Serviceleistungen (insbesondere Abwicklung der Bestell-, Rückgabe- und Schadenabwicklungsprozesse, Wartung und Reparatur, Störfallmanagement und Bereitstellung eines Online-Portals) auf der Grundlage von Einzel-Leasingverträgen zwischen Fahrradfachhändlern und Mitarbeitenden nach näherer Maßgabe der Leistungsbeschreibung. Der Auftragnehmer sichert zu, dass das Dienstradleasingmodell mit den gesetzlichen Bestimmungen und den steuerlichen Richtlinien im Einklang steht. Der Auftragnehmer sichert zu, dass es sich bei den Leasinggegenständen ausschließlich um neue, den Originalherstellerangaben entsprechende Fahrräder handelt und diese den Bedingungen des TV Fahrradleasing entsprechen. Die Höchstabnahmemenge beträgt bei einer monatlichen Abnahmemenge von 10 Fahrrädern bei einer Vertragslaufzeit von 36 Monaten insgesamt 360 Fahrräder und bei einer Vertragslaufzeit von 48 Monaten insgesamt 480 Fahrräder. Die absolute Abnahmemenge über die maximale Vertragslaufzeit beträgt 720 Fahrräder.
