Betriebliche Altersvorsorge (bAV) Der Auftraggeber ist ein kommunales Unternehmen. Die betriebliche Altersvorsorge der Beschäftigten wurde bislang über die Rheinische Zusatzversorgungskasse (RZVK) abgebildet. Im Zusammenhang mit einem Insolvenzverfahren in Eigenverwaltung ist diese Mitgliedschaft entfallen. Der Auftraggeber beabsichtigt daher, für den Zeitraum ab dem 01.02.2026 eine neue, private betriebliche Altersvorsorge einzurichten. Es besteht Tarifbindung; anwendbar sind der TVöD-K bzw. der Tarifvertrag für Ärztinnen und Ärzte (TV-Ärzte/VKA). Danach ist der Auftraggeber tarifvertraglich verpflichtet, einen Beitrag in Höhe von 4,25 % des jeweils maßgeblichen zusatzversorgungspflichtigen Entgelts der anspruchsberechtigten Beschäftigten zu leisten. Diese Beitragsvorgabe ist für die angebotene Versorgungslösung verbindlich und vollständig abzubilden. Ziel ist eine rechtssichere, wirtschaftliche, transparente und administrativ schlanke Versorgungslösung mit einem langfristig tragfähigen Versorgungsträger. Die Lösung soll • die Arbeitgeberhaftung und operative Risiken, soweit rechtlich möglich, begrenzen, • eine hohe Versorgungseffizienz für die Beschäftigten erreichen und • für unterschiedliche Beschäftigtengruppen praktikabel administrierbar sein. Gegenstand des Auftrags ist die Auswahl eines leistungsfähigen Versorgungsträgers bzw. Versicherungsunternehmens zur Einrichtung, Durchführung und laufenden Verwaltung einer betrieblichen Altersvorsorge für die Beschäftigten des Auftraggebers. Die Versorgung soll die infolge des Verlusts der bisherigen Zusatzversorgungsmitgliedschaft entstandene Versorgungslücke ab dem 01.02.2026 sachgerecht abbilden. Der vom Auftraggeber zu finanzierende Beitrag zur betrieblichen Altersvorsorge beträgt verbindlich 4,25 % des jeweils maßgeblichen zusatzversorgungspflichtigen Entgelts. Sämtliche Angebots-, Leistungs- und Vergleichsberechnungen sind auf dieser Beitragsgrundlage vorzunehmen. Der Auftrag umfasst neben der versicherungsförmigen Versorgung insbesondere: • die Implementierung, • die Bestandsaufnahme, • die Übernahme der Beschäftigtendaten, • die Beratung des Arbeitgebers, • die Information der Beschäftigten, • die Vertragsverwaltung, • die Beitragsabwicklung, • die Leistungsbearbeitung sowie • ein belastbares Reporting über die gesamte Vertragslaufzeit. Die Bieter haben ausdrücklich darzustellen, in welcher rechtlich und versicherungstechnisch zulässigen Form eine wirtschaftliche Rückwirkung zum 01.02.2026 umgesetzt werden kann. Soweit eine echte rückwirkende Risikodeckung nicht möglich ist, ist ein transparentes Alternativkonzept für die Nachfinanzierung bzw. Schließung der Versorgungslücke anzubieten.
