Description

Der Eifelkreis Bitburg-Prüm (nachfolgend: "Konzessionsgeber") hat den Bau und Betrieb von Gigabitnetzen sowie die Erbringung von Endkundendienstleistungen in Auftrag gegeben. Der Konzessionsgeber hat dazu im Rahmen des 6. Calls des Förderprogramms des Bundes Richtlinie "Förderung zur Unterstützung des Breitbandausbaus in der Bundesrepublik Deutschland" sowie im Rahmen der "Förderrichtlinie des Ministeriums des Inneren, für Sport und Infrastruktur Rheinland-Pfalz zur Förderung des Ausbaus von Hochgeschwindigkeits-Breitbandnetzen" endgültige Förderzusagen erhalten. Die vorliegende Konzession dient dazu, einem Konzessionsgeber im Sinne des § 101 Abs. 1 Nr. 1 GWB die Bereitstellung oder den Betrieb öffentlicher Kommunikationsnetze oder die Bereitstellung eines oder mehrerer elektronischer Kommunikationsdienste für die Öffentlichkeit zu ermöglichen. Daher sind gemäß § 149 Nr. 8 GWB das GWB-Vergaberecht, die EU-Vergaberichtlinien, die Konzessionsvergabeverordnung und sonstige Rechtsgrundlagen des förmlichen Vergaberechts im vorliegenden Verfahren nicht anwendbar. Das Verfahren wurde zweistufig als Verhandlungsverfahren mit vorgeschaltetem Teilnahmewettbewerb (vgl. § 12 Abs. 1 S. 2 KonzVgV) durchgeführt. Siehe allgemeine Beschreibung unter Ziff. 2.1
