Bewachungsdienstleistung in der Liegenschaft des Bundesverwaltungsamtes (BVA) in Berlin Gegenstand des Vertrages sind Bewachungsleistungen für das BVA in Berlin. Für die Bewachung der Liegenschaft besteht für den Zeitraum 01.11.2026 bis 31.10.2030 der Bedarf eines Sicherheitsdienstes. Optional kann der Vertrag einmalig um ein Jahr verlängert werden. Die Bewachungsdienstleistun umfasst im Zeitraum vom 01.11.2026 - 30.04.2027 zudem eine Urlaubs- und Krankenvertretung des bestehenden BVA eigenen Wachpersonals. Wichtig: Hierbei handelt es sich ausdrücklich nicht um eine Arbeitnehmerüberlassung. Die Bewachungsdienstleistung wird ausschließlich dann abgerufen, wenn eine der beiden Sicherheitskräfte des BVA urlaubs- oder krankheitsbedingt ausfallen. Eine Arbeitnehmerüberlassung im Sinne des § 1 AÜG entsteht zwischen einem Verleiher und einem Entleiher mit dem Inhalt, dass ein Arbeitnehmer von einem Arbeitgeber (Verleiher) einem Dritten (Entleiher) gegen Entgelt und für bestimmte Zeit zur Arbeitsleistung überlassen wird. In der Arbeitnehmerüberlassung würde der Arbeitnehmer in die Arbeitsorganisation des Entleihers eingegliedert und dessen Weisungen unterliegen. All dies ist im hiesigen Verfahren ausdrücklich nicht gegeben. Die Gesamtleistung bildet ein Los.
