Im Rahmen dieses Vergabeverfahrens ist der Mellowpark e.V., An der Wuhlheide 250, 12459 Berlin Auftraggeber. Dieser ist im vorliegenden Projekt aufgrund von öffentlichen Zuwendungen öffentlicher Auftraggeber im Sinne des § 99 Nr. 4 GWB. Für die Planung und Realisierung des Neubau BMX Halle Mellowpark in Berlin sind Fachplanungsleistungen zur Festlegung der objekt- und nutzungsspezifischen Brandschutzanforderungen gem. Leistungen für Brandschutz, AHO Schriftenreihe Nr. 17, Stand Dezember 2022, sowie die in den spezifischen Leistungspflichten näher beschriebenen optionalen Leistungen. Die Beauftragung erfolgt in Leistungsstufen. Ein Rechtsanspruch auf Beauftragung weiterer Leistungsstufen besteht nicht. Der Auftragnehmer ist verpflichtet, die Leistungen der weiteren Leistungsstufen zu erbringen, wenn der Auftraggeber sie ihm überträgt. Es gelten die Angaben aus § 3 des Vertrages Brandschutz IV 421.H F der A-Bau.
