Die AOK Bayern - Die Gesundheitskasse (nachfolgend "AOK Bayern" oder "Verkäuferin") ist Eigentümerin des Grundstücks in 91052 Erlangen, Schuhstraße 36, das mit einem 3-geschossigen (EG + 1. OG + ausgebautes DG) Büro- und Verwaltungsgebäude mit zwei Wohnungen bebaut ist. Die Nutzung als Büro- und Verwaltungsgebäude durch die AOK Bayern erfolgt voraussichtlich noch bis Herbst 2026. Die Übergabe an den Käufer soll spätestens zum 31. Dezember 2026 erfolgen. Die AOK Bayern beabsichtigt, das Grundstück in 91052 Erlangen, Schuhstraße 36, an einen Dritten zu veräußern. Die AOK Bayern führt zur Veräußerung des Grundstücks ein strukturiertes Bieterverfahren zum Höchstgebot durch. Es wird ausdrücklich darauf hingewiesen, dass es sich nicht um ein förmliches Vergabeverfahren nach den Vorschriften des Gesetzes gegen Wettbewerbsbeschränkungen (GWB) und der Vergabeverordnung (VgV) handelt. Soweit eine Bekanntmachung über die EU-Plattform für öffentliche Aufträge (TED) oder eine andere Vergabeplattform erfolgt, dient dies lediglich der Herstellung von Verfahrenstransparenz. Eine Unterwerfung unter vergaberechtliche Regelungen bzw. eine entsprechende Selbstbindung der Verkäuferin ist damit nicht verbunden. Bietern entstehen keine entsprechenden subjektiven Rechte. Die Teilnehmer haben keinen Anspruch auf Erstattung etwaiger Kosten für die Teilnahme an dem strukturierten Bieterverfahren. Zur Veräußerung des Grundstücks führt die AOK Bayern ein strukturiertes Bieterverfahren zum Höchstgebot durch. Das Verfahren zur Grundstücksveräußerung ist zweistufig ausgestaltet: - 1. Stufe: Interessenbekundungsverfahren - 2. Stufe: anschließendes Angebotsverfahren.
