Description

Mit der vorliegenden Bekanntmachung veröffentlicht die AOK Bayern aus Gründen der Transparenz alle im Rahmen der Open House Verfahren für Arzneimittelrabattverträge gem. § 130a Abs. 8 SGB V sowie § 130a Abs. 8c SGB V im Zeitraum vom 13.02.2026 bis 12.03.2026 geschlossenen Verträge. Die AOK Bayern beabsichtigt, mit allen interessierten pharmazeutischen Unternehmen nicht-exklusive Rabattvereinbarungen über die im jeweiligen Verfahren genannten Wirkstoffe nach § 130a Abs. 8 SGB V bzw. § 130a Abs. 8c SGB V zu schließen. Die AOK Bayern bietet allen interessierten pharmazeutischen Unternehmen, die die unten genannten Eignungsvoraussetzungen erfüllen, den Abschluss identischer und nicht individuell verhandelbarer Rabattvereinbarungen an. Ein Vertragsschluss ist während der Laufzeit jederzeit möglich. Die Verträge können mit einer Frist von einem Monat zum Monatsende gekündigt werden. Bei Inkrafttreten eines durch bundesweite oder landesspezifische, im offenen Verfahren geschlossenen Rabattvertrags über Arzneimittel mit dem auftragsgegenständlichen Wirkstoff treten die open-house-Vereinbarungen automatisch für die entsprechende Laufzeit außer Kraft. Ein Vertrag wird mit allen interessierten pharmazeutischen Unternehmen geschlossen, die ihre Eignung durch eine ausgefüllte und unterschriebene Eigenerklärung zur Zuverlässigkeit nachweisen. Einzelheiten können der Auftragsbekanntmachung zum jeweiligen Open House Verfahren im Amtsblatt der Europäische Union entnommen werden.
