Abschluss eines nicht exklusiven Rabattvertrages nach § 130a Abs. 8 SGB V zu Arzneimitteln mit dem Wirkstoff Levothyroxin-Natrium (ATC-Code: H03AA01) innerhalb des Zeitraumes vom 01.02.2026 bis zum 31.01.2028 mit jederzeitiger Möglichkeit des Vertragsabschlusses während der Laufzeit („open-house-Modell“). Zu dem Wirkstoff Levothyroxin-Natrium (ATC-Code: H03AA01) bietet die AOK Niedersachsen. Die Gesundheitskasse für den Zeitraum bis zum Inkrafttreten von Exklusivverträgen in Folge eines förmlichen Vergabeverfahrens nach den Regularien des 4. Teils des GWB allen interessierten pharmazeutischen Unternehmen, ohne Auswahlentscheidung, Rabattverträge an. Die Vertragsschlüsse erfolgen im Rahmen eines „open-house-Modells“ und fungieren als Brücke zwischen dem Beginn des generischen Wettbewerbs (Patentablauf) und der Bezuschlagung von Exklusivverträgen. Die angebotenen Verträge sind nicht exklusiv; Verträge mit allen Marktteilnehmern (pharmazeutischen Unternehmen) sind seitens der AOK Niedersachsen gewünscht. Im open-house-Modell gelten für alle Teilnehmer einheitliche Bedingungen. Vertragsinhalte, Konditionen und Zugangsverfahren sind einheitlich - individuelle Verhandlungen werden grundsätzlich nicht geführt. Die Vertragslaufzeiten betragen maximal vierundzwanzig Monate, der früheste Vertragsbeginn ist der 01.02.2026. Alle Verträge enden spätestens am 31.01.2028, unabhängig vom Datum des jeweiligen Vertragsschlusses. Ein Beitritt bzw. ein Vertragsschluss kann innerhalb des vierundzwanzigmonatigen Zeitraumes jeweils zum Ersten eines Monats erfolgen. Es besteht ein Kündigungsrecht jeweils sechs Wochen zum Monatsende. Die AOK Niedersachsen. Die Gesundheitskasse behält sich vor, bereits während der Vertragslaufzeit die nicht exklusiven open-house-Rabattverträge durch exklusive Rabattverträge zu ersetzen. Mit dem Inkrafttreten ausgeschriebener, exklusiver Rabattverträge werden die open-house-Verträge entsprechend der vertraglichen Regelung beendet, d. h. die open-house Verträge enden automatisch. Den Erfahrungen der AOK Niedersachsen nach treten exklusive Rabattverträge in der Regel sechs bis acht Monate nach der Veröffentlichung der entsprechenden Ausschreibungsbekanntmachung im Supplement zum Amtsblatt der Europäischen Union in Kraft. Die künftigen Vertragspartner im open-house-Modell werden gebeten, sich bezüglich dieser Ausschreibungsbekanntmachungen regelmäßig im Supplement zum Amtsblatt der Europäischen Union zu informieren. Interessierte pharmazeutische Unternehmen können die Vertragsunterlagen sowie die Vertragsbedingungen unter der unter I.1) genannten Kontaktadresse anfordern. Verträge zu dem Wirkstoff Levothyroxin-Natrium (ATC-Code: H03AA01) werden erstmalig mit Wirkung zum 01.02.2026 abgeschlossen. Interessenten, die zu diesem Termin Vertragspartner werden möchten, haben die einzureichenden Vertragsunterlagen bis zum 29.12.2025 bei der in den Vertragsunterlagen genannten Adresse einzureichen. Es kommt auf den Zugang bei der AOK Niedersachsen an. Spätere Vertragsschlüsse sind während der vierundzwanzigmonatigen Höchstlaufzeit jeweils zum Ersten eines Monats möglich. Organisatorisch ist ein Vorlauf von in der Regel 35 Kalendertagen seitens der AOK notwendig um die erforderlichen Arbeiten, z. B. die Vertragsmeldung in die Lauer-Taxe® gewährleisten zu können. Die genauen Eingangsfristen werden mit den Vertragsunterlagen bekannt gegeben. Bei der vorliegenden Veröffentlichung handelt es sich nicht um die Vergabe eines öffentlichen Auftrags im Sinne der Richtlinie(2014/24/EU) bzw. des Vergaberechts. Um ein weitestgehendes Maß an Transparenz für die beabsichtigten Vertragsabschlüsse zu gewährleisten, erfolgt die Veröffentlichung im Supplement zum Amtsblatt der Europäischen Union. In Ermangelung eines entsprechenden Veröffentlichungsformulars wird die Auftragsbekanntmachung genutzt. Die daraus resultierenden begrifflichen Vorgaben, wie bspw. die Verfahrensbezeichnung „offenes Verfahren“, sind einzig der Nutzung dieses Bekanntmachungsformulars und der Veröffentlichungsplattform geschuldet. Eine weitere Bedeutung, insbesondere eine Unterwerfung untervergaberechtliche Regelungen, soweit sie nicht aus rechtlichen Gründen verpflichtend sind, ist damit nicht verbunden.
