FMI har efter modtagelse og ibrugtagning af ni (9) FRB-både (Fast Rescue Boats) af typen Marathon fra VIKING Life-Saving Equipment A/S, CVR-nr. 15 01 62 13 (herefter "Leverandøren"), konstateret, at sædernes udformning i væsentlig grad begrænser besætningens evne til at opretholde den fysiske parathed og den koncentration, der er påkrævet for forsvarlig betjening af fartøjerne som FRB'er. Sædernes placering og udformning medfører endvidere, at brugerne ikke har tilstrækkeligt udsyn fra fartøjets styreposition under sejlads, hvilket udgør en operativ begrænsning, der forhindrer forsvarlig anvendelse af fartøjerne til det tilsigtede formål. Det er på den baggrund nødvendigt at foretage udskiftning af de to (2) sæder nærmest styrepulten på hver af de ni (9) Marathon-både. Et skifte af leverandør vurderes at ville medføre uforholdsmæssigt store tekniske vanskeligheder ved drift og vedligeholdelse, idet sædeudskiftningen forudsætter indgående kendskab til fartøjernes specifikke konstruktion og de tekniske installationer, herunder grænseflader mellem sæder, monteringsløsninger og fartøjets konstruktion. Leverandøren har som oprindelig leverandør kendskab til fartøjernes konstruktion og de leverede installationer. Et leverandørskifte vil derfor kræve en selvstændig teknisk afklaring af disse forhold og indebære risiko for uklar ansvarsplacering for ændringerne og de berørte installationer. FMI har derfor indledt forhandlinger med Leverandøren om udskiftning af de pågældende sæder med i alt atten (18) nye sæder af mærket ULLMAN, inklusive montering. Sædeudskiftningen udgør en supplerende leverance fra den oprindelige leverandør, idet den oprindelige kontrakt er afsluttet, og der er tale om en delvis fornyelse af installationer på de leverede fartøjer. FMI agter derfor at indgå kontrakt med Leverandøren om anskaffelse af de omhandlede sæder. Kontrakten vil ikke blive indgået før udløbet af 10 kalenderdage regnet fra dagen efter offentliggørelsen af denne bekendtgørelse.
